(Minghui.org) Ten months after a hearing of their appeals against the arbitrary suspension of their pensions, three Huili City, Sichuan Province, residents still haven’t received a decision from the higher court.
A fourth local resident encountered a similar ordeal and also appealed, but the appeals court declined to hear her case on the grounds that she didn’t provide sufficient information about her pension account to the social security bureau.
On May 25, 2023, the three residents filed a request with the Liangshan Prefecture Litigation Service Center, urging the Liangshan Prefecture Intermediate Court to uphold justice on their behalf.
The four Huili residents have had their pension suspended because they practice practice Falun Gong, a spiritual discipline that has been persecuted by the Chinese Communist Party (CCP) since 1999. The amounts suspended were 204,800 yuan for Ms. Zheng Qiong, 188,600 yuan for Ms. Ma Lingxian, 140,900 yuan for Mr. Xu Shikai, and 135,100 yuan for Ms. Luo Jiping. Among them, Ms. Ma has had her pension suspended the longest, since 2008.
The four practitioners filed lawsuits against the local social security bureau in 2021. They argued that the law protects workers’ rights to receive pensions “on a monthly basis” and “for life,” and that there is no legal ground for the social security bureau to stop the payments temporarily or indefinitely for any reason.
The court held two hearings in Ms. Luo’s case, on November 29, 2021, and January 10, 2022; one hearing in Ms. Zheng’s case on January 17; and one hearing of Mr. Xu’s and Ms. Ma’s cases on January 18. The same judge presided over all these cases.
Shortly after the hearings, the judge ruled in favor of the local social security bureau in all four cases. The practitioners appealed to the Liangshan Prefecture Intermediate Court, which declined to hear Ms. Ma’s case but accepted the other three practitioners’ cases. A joint hearing of their appeals was held on August 7, 2022.
As the three practitioners never heard back from the higher court, they went there on January 27, 2023, to inquire about the case status, only to be told that the presiding judge, Chen Qi, wasn’t available.
