Five Sichuan Residents’ Motion to Reconsider Their Prison Sentences Accepted by Intermediate Court

(Minghui.org) Six Falun Gong practitioners in Xichang City, Sichuan Province, and one of their spouses were arrested between July and August 2019. All seven of them were sentenced by the Xichang City Court on December 9, 2020.

Mr. Huang Biao was sentenced to five years in prison and fined 20,000 yuan.Ms. Luo Mingchun was sentenced to four years in prison and fined 20,000 yuan.Ms. Zhao Jun was sentenced to three years in prison and fined 10,000 yuan.Ms. Zhou Xianrong was sentenced to two years in prison and fined 8,000 yuan.Ms. Yu Hongying was sentenced to 18 months in prison and fined 6,000 yuan.Ms. Xu Shaoqiong was sentenced to 14 months in prison and fined 5,000 yuan.Ms. Zhou’s husband, Mr. Pan Jianrong, who doesn’t practice Falun Gong, was sentenced to six months in prison and fined 3,000 yuan.

After receiving the verdicts, Mr. Huang, Ms. Luo, Ms. Zhao, Ms. Yu, and Ms. Xu appealed to the Liangshan Yi Autonomous Prefecture Intermediate Court, which ruled to uphold their original verdicts on March 2, 2021.

On March 17, Ms. Zhao’s lawyer filed a complaint with Liangshan Yi Autonomous Prefecture Procuratorate against judge Yang Hongwu of the higher court for wrongfully rejecting his client’s appeal. Both he and Mr. Huang’s lawyer also filed a motion with the higher court, demanding a reconsideration of the practitioners’ case.

On May 24, Ms. Luo’s family filed complaints with the Liangshan Yi Autonomous Prefecture Procuratorate and Xichang City Procuratorate, against the police for illegally breaking in and searching their home, as well as arbitrarily detaining their loved one.

Ms. Luo’s lawyer filed a complaint in July against judge Yang for not accepting the lawyer’s defense opinion or his demand to investigate the illegal evidence. He filed the motion to reconsider her case as well.

Ms. Luo’s family filed another complaint in September against the guards at Xichang City Detention Center for torturing Ms. Luo and hanging her up in her cell. The Liangshan Yi Autonomous Prefecture Procuratorate later texted them and said they were investigating the case.

On October 11, Ms. Zhou and her husband Mr. Pan also filed a motion to reconsider their cases with the intermediate court. A judge informed them that their motions had been accepted and would be combined with the motions filed by Ms. Zhao, Ms. Luo, and Mr. Huang. It’s not clear whether the higher court has scheduled a hearing for their motion.

At the time of writing, Ms. Xu, Ms. Yu, Ms. Zhou and Mr. Pan have been released after serving their terms. Ms. Zhao and Ms. Luo remain at the Xichang City Detention Center. Mr. Huang has been taken to the Jiazhou Prison on April 13, 2021. His bedridden wife, who had relied on him as the sole caregiver, has been taken to a nursing home; she has developed Alzheimer’s disease and is unable to recognize people.
