In Second Trial for Ms. Mo Huiping, Ningxia 610 Officials Trample the Law

Falun Gong practitioner Ms. Mo Huiping was tried for a second time on October 23, 2013, by the Wuzhong City Intermediate Court. Officials from the Ningxia and Wuzhong City 610 Office used misrepresentations similar to those used during the first trial, to make it difficult for Ms. Mo's relatives and lawyer to provide a proper defense.

Local public security agents had been monitoring Ms. Mo's family members. When her relatives walked into the court room on the morning of October 23, 2013, they found that there were only four rows of seats, and only a few seats in the middle of the first row and some in the fourth row which were empty. Court security stopped them from taking the seats in the first row, claiming that they were reserved for officials from the Department of Justice. Ms. Mo's family had no choice but to take the empty seats in the back.

The 610 Office and Wuzhong City Intermediate Court officials had arranged for young people to fill the court room.

There was a large number of plainclothes police officers stationed around the courthouse on the day of the trial. Officer Zhou from the Ningxia 610 Office, Zhao Bin, and Ma Minglong from the Wuzhong City 610 Office were responsible for the police officers. A few people came in during the trial and filled the reserved seats in the first row.

Illegality of Convicting Practitioners of Falun Gong

Ms. Mo, her relative, and her lawyer from Beijing, who also represented her during the first trial, pleaded not guilty. The lawyer first stated that freedom of religion is a constitutional right guaranteed to each Chinese citizen. He then explained that subjective elements of the alleged crime, and the objective offense elements could not be established for this case.

When the lawyer pointed out that it was illegal to convict practitioners based on instructions given by the Supreme People's Court and Supreme People's Procuratorate, the Prosecutor responded, “The instructions from the Supreme People's Court and Supreme People's Procuratorate are our legal basis.” The defense lawyer ended his presentation by calling for the immediate release of Ms. Mo.

While the lawyer's defense went relatively smooth, presiding judge Ai Jinchun repeatedly interrupted Ms. Mo and her relatives' speeches. Whenever they mentioned that Falun Gong teaches people to be good people, judge Ai immediately stopped them. Ms. Mo expressed toward the end of her defense that she hoped the judge would make a wise decision. Judge Ai became extremely exasperated and verbally attacked her.

The entire trial lasted two hours and the process was video taped. A black car (License: Ning c.p0037) followed Ms. Mo's relatives after they left the courthouse, and they were photographed.

Ai Jinchun was the presiding judge, Tian Jinxian the judge, and Ding the clerk. Prosecutor Suo and Yang are both from the Wuzhong City Procuratorate. Judge Ai had previously sentenced practitioner Mr. Ma Zhiwu and Mr. Ma Xongde to prison terms. Many practitioners had tried to clarify the truth about Dafa to him.

Officials from the Ningxia 610 Office and Wuzhong City 610 Office had instructed officials of the many community residential committees in the city to monitor local practitioners a few days prior to Ms. Mo's second trial.

Ms. Mo's relatives completed the required court documents on October 20. However, the Wuzhong City Intermediate Court official called two days later and asked for additional documentation. They threatened that otherwise her relative would not be allowed to defend her. Ms. Mo asked why they were not consistent with legal procedures. The court official eventually yielded.

Recent Arrest and First Trial

Ms. Mo is a 37-year-old taxi driver. She had been illegally sentenced to three years of forced labor and a three and a half-year prison term for practicing Falun Gong. Her sister and brother-in-law, who are also practitioners, had been repeatedly arrested, detained, and fined. Her friend and younger brother had also been arrested.

Ms. Mo and Ms. Luo Xinping were arrested on February 16, 2013 by Deputy Director Wang Tao and officers from the Minsheng Street Police Station. Both were beaten and then detained at the Wuzhong City Detention Center, which recently merged with the Qingtongxia City Detention Center.

To resist their detention and torture, Ms. Mo and Ms. Luo went on a hunger strike. The guards pushed Ms. Mo to the ground, force fed her, and walked on her body. They took a photograph of it to show to Ms. Luo. Ms. Luo became seriously ill and has been released on a 2,000 yuan bail.

Since Ms. Mo went on a hunger strike and persistently resisted the persecution, she has been subjected to force-feedings through a tube inserted in her nose. She was given general anesthesia and had her nostrils slit.

Appealing for Release

Ms. Mo and Ms. Luo's family have gone to Wuzhong City Police Department and detention center many times since their arrest to appeal for their release. Officials of these agencies lied to evade responsibility. Zhao Bin, deputy director of the Wuzhong City Police Department Litong District Branch, and Ma Minglong, head of the Domestic Security Division, filed a lawsuit against Ms. Mo.

Prior to the first trial, her family tried to clarify the truth about Falun Dafa to presiding judge Du Weijun of the criminal court. Du claimed that it would be an open trial. However, he used various excuses to prevent Ms. Mo's family from attending the hearing or giving defense in court. Du, the 610 Office, and public security officials had Ms. Mo's family monitored, video taped, and photographed.

On the day of the trial, the officials placed a large number of plainclothes agents and vehicles outside the court, and many people inside the courthouse. They tried to stop her family from attending the hearing. The Domestic Security Division officers also called and harassed her family. Ms. Mo was sentenced to a four year prison term. Ms. Luo had to leave home to avoid being arrested again.

When Ms. Mo's family questioned judge Du Weijun about the sentence after the trial, Du responded, “The sentence was already set by higher-ups. I didn't have a say in the final decision.” As a judge whose duty is to uphold and enforce the law, Du instead acts as a puppet for the 610 Office.

Law Enforcement Agencies Violate Established Chinese Law

When the lawyer pointed out, “Distributing printed fliers is a peaceful and rational way of resisting the injustice and persecution of practitioners. It is a constitutional right. The practitioners don't have the motivation nor ability to undermine law enforcement.” Prosecutor Ma Lingyan didn't know how to respond. She became furious and shouted, “Distributing fliers is undermining law enforcement.”

The Chinese Communist Party's (CCP) rule of China is in fact based on lies and violence. Since the CCP took over power, many shocking and ignorant comments have been made by those without a conscience. When law enforcement officers make such comments in court, they are actually violating established Chinese law.
