The victim, Li Baoqing, is a prestigious researcher at the Geographical Institute of the Chinese Academy of Science, advisor to Ph.D. students, and receiver of a government special allowance. He is also a recipient of the Outstanding Employee Award of the Chinese Academy of Science for the "7th five-year Major Science and Technology Tasks". He has been listed in "The Dictionary of International Famous People" edited by the Center for International Famous People, Cambridge, England, v. 25, P233, 1997.
The following is a statement from the victim:
1. On February 7 2000, I could not enter my home because I had left my keys inside. , I had to go to the detention center to get the keys from my wife (she had been taken away previously and our apartment had been searched). Upon seeing that I was the husband of a Falun Dafa practitioner, they said to me: "So you are Liu Jinghang's husband. Are you also a Falun Dafa practitioner? Don't leave. We have something to ask you. Come and talk with us." Thus, failing to get the keys, I was put in custody for 38 days. Without any cause, I was detained just for visiting my wife to pick up the keys to our home. Where is the legality and human rights?
2. "Talking" with me, but intending to detain. After entering the building and before talking with anyone, my body was searched, personal property was taken, and my belt and hard items were taken away. They told me I had to pay for a sheet and comforter, took my picture, and collected finger and palm print. I was treated like a criminal. I had to obey. I asked them why they detained me. They said that: "To ask you questions under suspicion of harming the social order by practicing Falun Dafa." According to the "Police Law", I should be questioned in the police station, and should be released in 24 to 48 hours if no criminal activity was proven. But they detained me first, then questioned. There was neither fact, nor legal basis.
3. Detaining first, then issuing ticket. I was detained at about 1:00 pm, but a ticket was not issued until 8:00 pm. This surprised the prisoners in my cell. Although they were criminals, they complained that Falun Gong was persecuted too ruthlessly and unreasonably. When issuing the ticket, the police had already questioned me. I had committed no crime. This is the manifestation of the so called "devious theory and the fallacy of their authority surpassing human rights".
4. Detaining for a long time without any charges. The duration of detention on the warranty ticket was 30 days, from February 7 to March 7. But in fact, the date when I left the detention center was March 16, totaling 39 days. There was no amendment procedure during the period. Their explanation was that I was detained in the detention center for 30 days, the court examined the case for 7 days, totaling 37 days. But the fact remains that I was detained on February 7, and released on March 16, it was still actually 38 days, instead of 37 days. The claim of the court's examination is purely cheating. I was neither arrested, nor accused. Actually it was to sacrifice people's legal liberty at any cost to ensure the two meetings (the meeting of the National People's Congress and the meeting of the Chinese People's Political Consultative Conference). This is a typical violation of our human rights.
5. Regarding the citizen's legal right to appeal and practice a belief as indifferent law consciousness, violating the law (I once lawfully appealed), for consideration of committing light criminal, being released on bail and waiting for judgement. After leaving the detention center, there is still no freedom; even my private passport is still confiscated, which shows the continuing violation of my rights.
My personal experience showed that the Chinese government has severely damaged the constitution and violated human rights. (April 11, 2000)
