(Minghui.org) Falun Gong practitioner Ms. Zeng Xiaolin filed a lawsuit to China’s Supreme Court in June 2015, accusing Jiang Zemin, the former Chinese Communist Party dictator, of crimes against humanity.

Four months later on November 3, Li County police arrested Ms. Zeng and took her to Baiheshan Detention Center in Changde City, Hunan Province.

Li County Court conducted a hearing on March 23, 2016. Ms. Zeng’s family hired Attorney Cai Ying from Changsha City to defend her. The attorney challenged the legality of the trial and pointed out that her client was formally arrested on November 4, 2015, but the “evidence” was not obtained until the next day.

The lawyer argued that the police made the arrest before they had any “evidence,” thus making the lawsuit invalid. The judge knew the hearing could not proceed and announced a trial suspension.

The court held a second hearing on July 14. Attorney Cai delivered another powerful defense, and asked the court to dismiss the case and release Ms. Zeng.

The court again did not reach a verdict. The judge indicated that Ms. Zeng could be released on bail. There was no follow up, and Ms. Zeng remains in detention.

Unwilling to hold the case any longer, Li County Court handed the case over to Changde Intermediate Court. Under China’s law, a suspect can be held pending investigation no more than 7 months. But Ms. Zeng’s detention has lasted more than 10 months.

Background

In 1999, Jiang Zemin, as head of the Chinese Communist Party (CCP), overrode other Politburo standing committee members and launched the violent suppression of Falun Gong.

The persecution has led to the deaths of many Falun Gong practitioners in the past 17 years. More have been tortured for their belief and even killed for their organs. Jiang Zemin is directly responsible for the inception and continuation of the brutal persecution.

Under his personal direction, the CCP established an extralegal security organ, the “610 Office,” on June 10, 1999. This organization overrides police forces and the judicial system in carrying out Jiang's directive regarding Falun Gong: to ruin their reputations, cut off their financial resources, and destroy them physically.

Chinese law allows for citizens to be plaintiffs in criminal cases, and many practitioners are now exercising that right to file criminal complaints against the former dictator.
