(Minghui.org) Ms. Chen Huiran was sued by the Baoding Xinshi District Procuratorate on October 16, 2014. The lawsuit was filed in the Xinshi District Court.
Ms. Chen's lawyer said, “They don't have the legal authority to sue Ms. Chen.”
Ms. Chen was illegally arrested at home on May 14, 2014, by the Xinshi District and Nanshi District Domestic Security Division. The officers were in plainclothes and refused to identify themselves. They ransacked her home and confiscated Falun Gong informational materials, a computer, and other personal belongings. She was taken to the Baoding Detention Center.
The Xinshi District Domestic Security Division submitted evidence charging Ms. Chen to the Xinshi District Procuratorate. The Procuratorate released Ms. Chen on June 12, 2014, saying the evidence was insufficient.
Ms. Chen received a phone call from Xinshi District Domestic Security Division on August 13. They asked her to come to their office. On arrival, she was arrested and detained.
After being arrested a second time, her family hired an attorney.
The attorney visited the Xinshi District Procuratorate and argued that Ms. Chen was not under the jurisdiction of the Xinshi District, since she lives in Nanshi District, and that making an arrest and searching her home without a warrant was against the law. The attorney demanded that Ms. Chen be released immediately.
Officials at the Procuratorate refused to respond to the lawyer's questions. They claimed that her case was not formalized. The attorney explained to them the proper procedure for filing a case and said that they shouldn't file a lawsuit against Ms. Chen without a legal basis.
The Baoding Xinshi District Procuratorate filed the lawsuit anyway.
