Sun Jianfeng from Ningxia Province Illegally Sentenced--His Lawyers Prevented from Getting Involved

(Minghui.org) On November 20, 2012 Falun Gong practitioner Mr. Sun Jianfeng was secretly sentenced to five years and four months in prison by Shapotou District Court in Zhongwei City, Ningxia. The court did not inform Mr. Sun's family, and also hid the trial and sentencing from Mr. Sun's defense lawyer. It wasn't until late November that Mr. Sun's family learned the news. They asked the lawyer to intervene for a retrial, but the lawyer had been obstructed and deceived by the officials from Zhongwei City Police Department, Procuratorate, and judicial system, and is still not able to meet with Mr. Sun.

Falun Gong practitioner Sun Jianfeng's family learned in late November 2012 that Mr. Sun had been secretly sentenced. They contacted the previously hired defense lawyer whose family name is Wang, hoping that Lawyer Wang can defend Mr. Sun during the second trial.

Lawyer Wang went to Zhongwei City Detention Center on December 19, and requested to meet with Mr. Sun Jianfeng. The guard on duty at the detention center flatly refused him, and said that he must first get permission from Shapotou District Domestic Security Division in Zhongwei. The detention center's director, whose family name is Cui, subsequently deceived the lawyer, and said, “Sun Jianfeng hired a new lawyer, and you do not need to defend him.” The lawyer explained that he had a contract with Mr. Sun's family. If they do not want him, they or Mr. Sun Jianfeng need to notify him in person or written notice. The director did not say anything. Then, Lawyer Wang tried to call the person at Shapotou Procuratorate who is in charge of the case, but could not reach him. The lawyer reported this to the superior authority of the prison investigation section, but they said they could not do anything.

The following is a brief description of persecution suffered by Mr. Sun:

Sun Jianfeng, 40, was a worker from Yinchuan Power Supply Section, the Lanzhou Railway Bureau. He and Huang Yuxia visited Chang Xiue on March 30, 2012. Zhongwei City Domestic Security Division captain Li Jinjun, and instructor Li Chunshan, led several police officers, including policeman Li Zhanhong, and followed them. They broke in while Chang Xiue was opening the door. All three persons were arrested and taken away. They ransacked Chang Xiue's home, and looted computers and other personal belongings. Three persons were taken to the Zhongwei City Police Department where they were tortured for confessions. Police Li Cunshan handcuffed Huang Yuxia, and kicked and beat her. He slapped her face and tortured her on the tiger bench. He also slandered Falun Gong. On the same night, Li Cunshan led a group of people to raid Huang Yuxia's home. They stole computers, printers, and other personal items.

Three Falun Gong practitioners were sent to a local hospital for physical examination while they were detained in Zhongwei City Police Department. Huang Yuxia and Chang Xiue were released later. This was exposed on the Minghui website, which made officials at the Zhongwei City Domestic Security Division furious. They arrested and detained Huang Yuxia a second time, detaining her for 15 days. Sun Jianfeng was held in Zhongwei City Detention Center from the beginning.

The Shapotou Procuratorate filed a lawsuit against Mr. Sun on July 11, 2012, charging him with the so-called crime of "utilizing evil religious organizations to undermine the implementation of the law." Shapotou District Court subsequently approved Lawyer Wang hired by Mr. Sun's family to defend Mr. Sun, and set the trial date for August 10.

When Mr. Sun's friends and relatives arrived at the court on August 10, they were told the trial was temporarily canceled, and the new trial date was unknown, but that they would be notified later. It was learned that the Shapotou District Court delayed the trial because they were afraid of people hearing the lawyer's defense.

In the following days, Mr. Sun's elderly parents went everywhere to appeal. But the relevant departments rejected their requests. The Shapotou District Court said that this case had been handed over to higher authorities; the instructor from the Domestic Security Division, Li Cunshan, who arrested Mr. Sun had changed jobs and moved away; and the new head of the 610 Office, Tuo Zhaowang, said he did not know much about the case. No officials from law enforcement or other related departments wanted to take responsibility. The detention center refused to release him. His parents wrote letters to a number of governmental departments to appeal, but have not received any responses. It was said that Mr. Sun had prickly heat all over his body, the prison guards force-fed him medicine, and several of his teeth were pried out. His parents were very concerned.

In late November, Mr. Sun's family, who were waiting for the trial date, suddenly got the message that Sun Jianfeng, who had been detained for eight months, had been secretly sentenced to a five-year and four month term by Shapotou District Court on November 20. Even the lawyer hired by his family was unaware of this. Mr. Sun's family found Liu Wenhong, the president of criminal court at Shapotou District Court and asked for the reason. He remained silent in the beginning, and later said, “Ask the president of Shapotou District Court.” So the president did not convict Mr. Sun based on fact and law, but based on the District Court president's will! When Mr. Sun's family tries to appeal, they are ignored.

Since Mr. Sun was arrested nine months ago, his family has not been allowed to see him. They are very concerned about his safety. He had been persecuted before and every time he was released, he was on the verge of death. In this nine months, each step from arrest to trial is conducted secretly by the police, the prosecutor, and the judicial system. The lawyer is not allowed to see Mr. Sun, and is deceived with obstruction and cheating. This shows the true face of "law enforcement” in China.

Mr. Sun has continued to appeal for Falun Gong. He was sent to a labor camp four times. He was subjected to slave labor, brutal force-feeding, being frozen, long-term monitoring, and up to 72 days of the hanging by handcuffs torture. When he was released the last time, his hair and beard were very long, never cut, and he was mentally disoriented. The back of his winter jacket was torn, and his pants were worn out in the buttocks area. His feet, legs, and knees could not bear weight, and his toes were deformed; the entire soles of his feet were covered with a thick layer of hard calluses. He had to lay in bed for more than two months before he recovered enough to walk. He still has scars on his wrists left by being hung up for such a long time.

Mr. Sun has followed Truthfulness-Compassion-Forbearance since he began practicing Falun Gong. He always considers others first, and is very kind to others. He worked hard for his employer, and is very good to his parents, siblings, relatives, and friends. He has committed no crimes, and does not have a motive or even the ability to commit a crime. He did not “use” any “evil organization” and there is no victim in this case. According to the law, Mr. Sun did not commit any crime! Instead, officials from the Zhongwei city police, prosecutor, and judicial systems have committed evil outrageous acts!
