(Clearwisdom.net) On the morning of February 7, 2012, in a court near the Baoshan District Detention Center, three Falun Gong practitioners—Ms. Yao Juying, 64, a retired teacher from Qibao Middle School in Shanghai; Mr. Gao Yuanzhen, in his 60s; and Mr. Tang Renya—stood trial. Ms. Yao declared her innocence and protested the persecution. The location and the time of the trial were changed without notifying the practitioners' families. The judge that day was Xu Minfang and the prosecutor was Tan Qimin. Their next trial was held February 26.
The judge, Xu Minfang, who is in her 40s, is the vice president of the Baoshan District Court Criminal Division. She has participated in the persecution of many Falun Gong practitioners, such as Mr. Guo Xiaojun, a young lecturer of the Shanghai Jiaotong University Computer Science Department; a family of three from the Baoshan District (Mr. Ying Zhiming; his wife, Ms. Zhang Xiufang; and their son, Ying Yeqi); and Mr. Lu Weidong, a practitioner from the Hongkou District, Shanghai.
Before Mr. Guo Xiaojun's hearing, Chief Judge Xu Minfang threatened the defense lawyer not to debate or bring up his view of Falun Gong. Otherwise, the lawyer would not be allowed to speak and might even be banished from the courtroom. She knew that any debate on Falun Gong would show that the persecution was illegal and absurd.
During the hearing, Mr. Guo brought up the details of how the police had interrogated him using torture, threatened him and his wife and child, deprived him of sleep, and intimidated him with instruments of torture. Xu interrupted him constantly. When it was time for Mr. Guo's statement, Xu interrupted him whenever he spoke about his practice of Falun Gong. He was later not allowed to speak and had to just hand in his statement.
Xu's conduct was a blatant violation of the litigant's and defense lawyer's right to a defense. She brazenly disregarded the Constitution, the Criminal Law Code, and the laws governing lawyers and judges She was afraid that the brutal torture Mr. Guo endured would be exposed and how Falun Dafa changed people for the better would become public knowledge. This law-enforcement official violated the law herself.
Falun Gong practitioners clarify the truth to people and will not give up their belief. These are the rights that the Constitution guarantees its citizens, and they should be protected, not ignored. The law-enforcement officials that abuse the law and think they are above it should be brought to justice.
