  • After Ms. Zhang Xinyi Was Granted UN Refugee Status, the Cambodian Government Deported Her to China; She Was Arrested Again and Her Whereabouts Are Unknown

    On April 28, 2005, Falun Gong practitioner Ms. Zhang Xinyi was again arrested in Changsha, Hunan Province. Her home was ransacked and her current whereabouts are unknown.

    Ms. Zhang Xinyi and her husband Mr. Li Guojun are Falun Gong practitioners who were granted refugee status by the United Nations Refugee Agency in Cambodia. They were arrested in Phnom Penh on August 2, 2002, and returned to China on August 9. They were taken into custody in Changsha City, Hunan Province after their return to China.



    Under Pressure from School Authorities, a Young Teacher's Father Resorts to Violence to Force Her to Renounce Falun Gong

    On February 18, 2004, Ms. Yuan Ming, a young teacher in Guangzhou City, Guangdong Province, returned home from class. Her father, under the influence of the Chinese Communist regime's propaganda and persecution, pulled the cord out of the telephone, came up behind Ms. Yuan, and suddenly wrapped it around her neck. After Ms. Yuan Ming struggled and got away, her father caught her again, wrapped the cord tightly around her neck, and almost strangled her. Frightened by her father's wild behavior, Ms. Yuan Ming could not think straight. In her confused mental state, she wrote the so-called Guarantee Statement not to practice Falun Gong any more.

    Her father is a high-level intellectual under the control of CCP. When Ms. Yuan Ming told her mother what her father had done, her mother, a People's Congress member, only replied, "I have investigated and found that your father's behavior was only negligence."

    <>Ms. Yuan Ming, 29, is the only daughter in her family. In the past few years, because of practicing Falun Gong, Ms. Yuan Ming has been persecuted many times and was detained for brainwashing for a long time. She was last arrested on December 15, 2004, and sent to the notorious brainwashing class in Chatou, where she remains to this day.

    In 2002, when the school forced all the teachers and students to attend a meeting to condemn Falun Gong, Ms. Yuan Ming spoke out frankly to defend Falun Dafa and also clarified the truth to teachers and students through her personal cultivation experiences. Against her will, the school sent her to a brainwashing class in Chatou, Guangzhou, the so-called "Legal Education School." Ms. Yuan suffered from physical and mental persecution. She was not "released" to return to teaching until 2003. Out of her compassion as a practitioner, Ms. Yuan Ming clarified the truth about the persecution of Falun Gong to her colleagues and students through her personal experiences of being persecuted in the brainwashing class.

    Some people were still deeply poisoned and spread rumors to defame Falun Gong, including Economics Department teacher Ms. Mo, teacher He from the Administrative Department, and student Chen Jinghe. They reported Ms. Yuan Ming to the school authorities. Some officials of the Guangzhou Evening University used the school's name and colluded with the residential administration and the police station to immediately put pressure on Ms. Yuan Ming. They used both persuasion and threats, but none of their tactics worked on her. Therefore, they secretly called Ms. Yuan's father and threatened and intimidated Ms. Yuan Ming's parents.

    Ms. Yuan Ming's father was afraid that his daughter might lose her job, so he begged the school authorities to keep Ms. Yuan's position. As a trade off, the school officials took advantage of the man's hot temper and lack of rationality to get him to "help educate" his daughter, not allowing her to clarify the truth. Pressured by the "red terror," her father was worried and scared, and he suffered extreme anguish. His rationality and morality were so completely twisted that he even persecuted his own daughter.

    After 9:00 p.m. on February 18, 2004, Yuan Ming finished her lecture and returned home. Her father had been waiting for her for a long time. Shadowed by his bad experiences during the "Great Cultural Revolution" and controlled by the evil communist spirit, Ms. Yuan's father pulled the cord out of the telephone, came up behind his daughter, and suddenly wrapped the cord so tightly around her neck that Ms. Yuan almost couldn't breathe. After Yuan Ming struggled free, her father once again caught her, tied the cord around her neck tightly and almost strangled her. Even though he is a high-level intellectual, Ms. Yuan's father lost all self-control and rationality.

    The next day, when Ms. Yuan Ming ran into Wang Jun from the school security section, she questioned him. Wang Jun said, "I called your father and we just had a casual conversation." But this "casual conversation" almost caused a terrible tragedy!

    Less than a month after this incident, the vice-president of the school, Wang Guoquan, ordered Ms. Yuan Ming to talk to Wang Jun in security. In the security section, she met Security Section Chief Wang Jun and the director of the school office, Zhang Ronglie. Wang Jun said, "The Communist Party committee director and I talked to your father and asked him to 'educate' you. We told him to pay attention to his methods and not to use violence. Your father's temper is very bad. You know, I often get in touch with your father." Zhang Ronglie said, "You should talk to your father about his behavior, not us. Did he violate any law?" Ms. Yuan Ming said, "It was not only illegal, it was a crime. I want to make a suggestion to the school: if you have any issue, you can talk to me directly, not to my father." Zhang Ronglie said, "We cannot accept this suggestion." Shortly after, Zhang Ronglie found an excuse to exempt Ms. Yuan Ming from her role as a student advisor so as to decrease her contact with students.

    The authorities not only persecute determined practitioners directly but also apply strong pressure to practitioners' families. They intimidate and threaten them so much that some family members even lose their senses. Controlled by the evil factors behind them, they do bad things to their own families. This incident is also an example of the cruel and evil nature of the Communist Party.

    In this multiparty persecution of Ms. Yuan Ming by the police station, her workplace and her family, Ms. Yuan's father was the person who carried out the persecution directly, but he was just a tool. The police station and some of the school officials were the genuine instigators. They used another person's hands to carry out the persecution. These people themselves are also being used by the evil, and they are victims of the Party culture. Each of them plays a different role in doing deplorable things.

    Ms. Yuan Ming's mother, as a member of the People's Congress, didn't protect her own daughter who believes in Zhen-Shan-Ren (Truth-Compassion-Forbearance). On the contrary, she supported the school. Regarding her husband's behavior, she only said, "I have investigated and found that his behavior was merely an error." Ms. Yuan Ming actually called her mother and told her that her father's dangerous actions were totally wrong and also said that, even if her father could evade human laws, he could not escape the punishment of heavenly law. Her mother's work phone was monitored, so many of her colleagues learned that Ms. Yuan Ming was persecuted and that her mother had tried to find excuses to defend the persecution.

    Poisoned by the Communist Party's evil culture for a long time, Ms. Yuan Ming's parents thought that "arms cannot fight with legs" and "only those people who understand the times are wise people," so they thought they were in the right and put aside morality and conscience. When Ms. Yuan Ming was detained in a brainwashing class in 2003, her parents were so fearful that, for an entire year, they didn't dare ask about the persecution their daughter was suffering in the brainwashing class. They clearly know that their daughter was illegally detained and persecuted by the Chinese Communist regime, but the parents instead have accused their daughter and found her guilty.

    Around 8:00 a.m. on December 15, 2004, because she had been clarifying the truth to students about the persecution of Falun Gong and exposing the viciuos lies on the notice boards and in her classes, Ms. Yuan Ming was arrested again and sent to the notorious brainwashing class in Chatou, where she remains illegally detained.

    The evildoing regime in Mainland China is currently carrying out mass arrests of Falun Gong practitioners. According to information from various sources, the arrests, which are targeted at Falun Gong practitioners, are carried out nationwide in a unified manner. Recently, we have learned of the following arrests and home ransacking incidents in Hebei, Hubei, Hunan, Shanxi, Shandong, Jilin, Jiangsu, Liaoning, and Beijing:

    Personnel from the 610 Office in Cangli County, Hebei Province Arrested More than 100 Falun Gong Practitioners

    Personnel from the 610 Office in Cangli County, Hebei Province have arrested more than 100 Falun Gong practitioners, sent them to brainwashing classes, ransacked their homes and confiscated their Falun Gong books. These Falun Gong practitioners have to sleep on a desk or on the classroom floor. The brainwashing class is still continuing.

    The Police in Kuancheng County, Hebei Province Arrested Three Falun Gong Practitioners

    On April 20, 2005, the National Security Group of the Police Department of Kuancheng County, Hebei Province illegally searched the homes of the practitioners they believed to be diligent in Falun Dafa cultivation. Practitioners found to have Falun Gong materials or possess the Nine Commentaries were illegally taken away. So far, three practitioners have been taken away and are being held in the county detention center. They are Jin Wensheng, Zhang Suqin and Yuan Zixing.

    Police in Tongcheng County, Hubei Province Persecute Falun Gong Practitioners with a Vengeance

    Since April, policemen of the National Security Team have viciously persecuted Falun Gong practitioners. Several practitioners have been arrested and their homes ransacked. Falun Dafa materials production facilities were destroyed.

    At about 8 o'clock on the morning of April 18, Xiong Linqing, head of the county 610 Office, policemen Yang Xiong and Zhang Ding'er from the National Security Team and other corrupt officials arrested practitioner Hua Taofeng. They took him to the provincial brainwashing class in Tangxunhu, Wuhan for persecution.

    Falun Gong Practitioner Lei Jiangping from Xianning, Hubei Province Arrested

    On April 21, ruthless officials arrested practitioner Mr. Lei Jiangping from the Xianning City Printing Factory.

    610 Office Personnel Arrest Falun Gong practitioner Wang Qing from Hanchuan City, Hubei Province

    While he worked in Xiangfan, Hubei, Falun Gong practitioner Wang Qing from Hanchuan delivered newspapers, and at the same time took the opportunity to clarify the truth to people. In mid-March 2005, the police arrested and incarcerated him in a detention center for fifteen days. After Wang Qing returned home in Hanchuan, officers from the local 610 Office again arrested him. He is now detained in the Provincial Law Education Center [a name for a brainwashing facility] for forced brainwashing.

    A Falun Gong Materials Production Facility in Feng County, Hunan Province Destroyed. Practitioners On Site Were Arrested

    A Falun Dafa materials production facility in Feng County, Hunan, has been destroyed. Falun Gong practitioners Qu Jiaxin and Zhang Zhonglian were arrested on April 15, 2005. According to a news source, Qu Jiaxin and Zhang Zhongnian were arrested while at work producing Falun Gong materials. They are currently locked up in the Feng County Detention Center, along with Ms. Zhang Zhonglian.

    On the afternoon of April 20, 2005, officers from Qishan County Police Department arrested practitioner Zhao Gencang at his home. They said they wanted to ask him something, but they have not released him yet.

    Mass Arrest of Falun Gong Practitioners Takes Place in Qingzhou City, Shandong Province Around April 20, 2005

    Around April 20, 2005, officers from Qingzhou City, Shandong Province carried out mass arrests of practitioners. As far as we currently know, they raided some practitioners' homes. Some practitioners were arrested and some Falun Gong materials-production facilities were ransacked. The exact number of practitioners arrested and detailed damage to the materials production facilities are yet to be investigated.

    Lawless Officers in Qingdao City Carry out a Large-Scale Raid on Practitioners' Homes

    According to sources in Qingdao City, the municipal secretary-general in charge of Falun Gong issues in Qingdao City had been to Beijing to attend a national conference. It seemed the attendees were from all parts of China. After his return he mentioned that there would be a large, nationwide campaign against Falun Gong practitioners, and there would be a large-scale house-search and arrest in Qingdao City as well. He also stated that one could be sentenced if found to have even one copy of the Nine Commentaries on the Communist Party. Many practitioners in Qingdao found they were being followed.

    Practitioners Xie Chunwei and Ji Hua from Qingzhou City in Shandong Province Are Arrested

    On Sunday, April 17, 2005, practitioners Xie Chunwei and Ji Hua went to Gu Liangjing's home to share their experiences and were arrested by personnel from the Mianshang Police Department in Qingzhou City.

    Crimes Committed by Xu Wende, 610 Office Head and Others in Qingzhou City, Shandong Province

    At around 3:00 p.m. on April 18, 2005, Xu Wende, head of the 610 Office in Qingzhou City, led more than ten people to Falun Gong practitioner Xu Baohua' home. They arrived in four cars, and forcibly broke into Xu's home, using clubs to gain entrance. They arrested Xu Baohua, searched his home and confiscated personal belongings, including one computer and two tape recorders. They also took 30,000 yuan in cash and Falun Gong materials, including books, tapes, CDs and other items. Later, they broke into practitioner Wang Shumin's home. Although no one was at home at the time, they still took away one TV set, one VCD player and some Falun Gong materials.

    Practitioners Ms. Shi Huiying and Ms. Li Sumei from Qingzhou City in Shandong Province were arrested

    Ms. Shi Huiying and Ms. Li Sumei are from Wanfang Village, Tanfang Town, Qingzhou City, Shandong Province. At around 9:00 p.m. on April 15, 2005, while they were distributing truth-clarifying materials in the neighboring village, Shi Huiying and Li Sumei were arrested. The arresting officers were from Tanfang Town Police Station. The practitioners' whereabouts are currently unknown.

    Ms. Lu Fengying from Jining City, Shandong Province Arrested

    Ms. Lu Fengying, 37, is from Jining City, Shandong Province. She was arrested on April 16, 2005 while distributing truth-clarifying materials in a local city. Now she is incarcerated in a local detention center.

    Ms. Xu Qiuxia from Jinan City, Shandong Province Arrested

    Ms. Xu Qiuxia, over 60 years old, is from Jinan City. She was reported to the police while distributing truth-clarifying materials. On April 15, 2005, fourteen officers from Nanjiao Police Station and other units came to her home. They arrested her and took her to the so-called Jinan Law Enforcement Training Center (a brainwashing center). Her family members were forced to stay with her and undergo brainwashing along with her.

    Practitioner Bi Xiaoying in Liaoyuan City, Jilin Province Arrested

    On April 19, officers from the National Security Branch of the Liaoyuan City Police Department broke into practitioner Bi Xiaoying's home. They searched the home and found a copy of the booklet Nine Commentaries on the Communist Party. Bi Xiaoying was taken away. Her whereabouts are currently unknown.

    Several Practitioners from Ganyu County, Lianyuangang City, Jiangsu Province Arrested

    After several practitioners were arrested a few days earlier, practitioners Song Pengcheng and Sang Tongxiu from Ganyu County, Lianyuangan City were also arrested. Currently, almost all the veteran practitioners in this area have been arrested, and the local contact with the Minghui/Clearwisdom website is thus severed.

    Seven Practitioners in Foyedong, Lingyuan City, Liaoning Province Arrested

    On the evening of April 23, 2005, Gao Xiuchun, a policeman from the Foyedong Police Station led officers from Lingyuan City Police Department to a practitioner's home. They broke into the home and arrested seven practitioners, including Ge Lihua, Li Yuhua, Liu Guilong, Guo Yuhua, Yang Sulan and two other practitioners whose names are unknown.

    Practitioner in Beijing's Shijingshan District Arrested

    On the evening of April 22, 2005, the police arrested a practitioner from his home in Shijingshan District in Beijing. His whereabouts are currently unknown.

    An Analysis of the Heavy Sentences Imposed by a Court in Beijing Against Ms. Chu Tong, Mr. Yu Chao and Mr. Wang Weiyu

    The following is an analysis of the heavy sentences imposed by the Chaoyang District People's Court in Beijing City against Ms. Chu Tong, Mr. Yu Chao and Mr. Wang Weiyu:

    1. Background Information

    Ms. Chu Tong, 33 years old, was a lecturer with a Master's degree at the Institute of Microelectronics of Tsinghua University. On October 27, 1999, she went to the Beijing Tiananmen Rostrum to appeal for justice for Falun Gong. For this, she was sentenced to 18 months of imprisonment. After being released from jail, she made a "Solemn Declaration" on the Clearwisdom website expressing her determination to practice Falun Dafa. After doing that, she was forced to leave her home and become homeless to avoid being arrested and persecuted.

    Mr. Yu Chao, 31 years old, is Ms. Chu Tong's husband. He graduated from the Department of Precision Instruments and Mechanical Engineering of Tsinghua University in 1990, and he later became a network engineer. In 2000, he was sentenced to one year of forced labor (to be carried out outside the forced labor camp) for going to Tiananmen Square in Beijing to display a banner reading, "Falun Dafa is a Righteous Fa." To avoid further persecution, Mr. Yu was forced to leave home and became homeless. On August 13, 2002, he and his wife were arrested by officials from the 610 Office and the Ministry of State Security. They were taken to a so-called "Legal Training Center" located in Tuanhe, Beijing.

    Mr. Wang Weiyu, 30 years old, was a 1996 Ph.D. student in the Department of Precision Instruments and Mechanical Engineering of Tsinghua University, where he received an "Outstanding Student" award as well as several scholarships, including the "Outstanding Student Scholarship" and the "Philips Scholarship." In September and October of 1999, Mr. Wang was detained twice for attending Falun Dafa experience sharing conferences. In June 2000, he was suspended from school once again. On July 22 of that year, he was detained for one week when he was found talking to people in Tiananmen Square. After this incident, he was forced to leave home and became homeless to avoid being arrested again. On August 12, 2002, Mr. Wang was secretly arrested by State Security Ministry officers on his way to work.

    2. A Brief Account of the Cases

    Ms. Chu Tong and Mr. Yu Chao were arrested on August 13, 2002 in the street, and Mr. Wang Weiyu was arrested on August 12, 2002, on his way to work. They were all escorted to the Beijing Legal Training Center after their arrests. When their arrests were formally approved on February 21, 2003, they had already been detained in the Legal Training Center for six months and eight days and six months and nine days respectively. On December 25, 2003, the Chaoyang District Procuratorate of Beijing instituted legal proceedings against the three in the Chaoyang District People's Court. From the approval of the arrest to instituting legal proceedings, it took ten months and four days. On January 9, 2004, the Chaoyang District People's Court made a decision and made public the venue and time for their hearing. Just one day before the hearing, however, the court suddenly changed the venue to Chaoyang District's Shuangqiao People's Court. On April 22, 2004, the Chaoyang District People's Court of Beijing sentenced Ms. Chu Tong to eleven years of imprisonment, Mr. Yu Chao to nine years and Mr. Wang Weiyu to eight years (document number "2004 Chao Xing Chuzi Number 75"). All three of them refused to accept the ruling, and appealed to the Beijing Number Two Intermediate People's Court.

    3. An Analysis of the Cases

    a). Was it "living in a residence under surveillance" or simply detention?

    Ms. Chu Tong and Mr. Yu Chao were arrested on August 13, 2002, and Mr. Wang Weiyu on August 12. They were held at the Beijing Legal Training Center. At the time that their arrest was approved on February 21, 2003, they had been detained for six months and eight days and six months and nine days respectively. In the Bill of Indictment of the Chaoyang District Procuratorate, and in the ruling of the People's Court, this period of time was described as "living at a residence under surveillance." This term refers specifically to an institution that handles cases where people accused of crimes are ordered to stay at a designated residence. The accused is not allowed to leave the premises without consent, and has certain restrictions on his or her movements. The "Regulations on the Procedures for Handling Criminal Cases," issued by the Ministry of Public Security, describes this residence as a full-time place of residence. As for who is to be placed there, it is described as a residence designated by the institution that handles the case for those who have no permanent home. The regulation clearly states that it is not allowed to establish a residence for the purposes of surveillance in order to carry out detention of suspected criminals, and that the duration shall not exceed six months.

    The Legal Training Center where Ms. Chu Tong, Mr. Yu Chao and Mr. Wang Weiyu were held was neither their own homes nor a designated dwelling. The period of detention exceeded the six-month limit. Beyond this, the three of them also suffered various mental and physical tortures, including the "dead person's bed (1)," being handcuffed with both hands to a bed and being tied to the bed. The Beijing Legal Training Center is a place specifically used for persecuting Falun Gong practitioners. It is an unacknowledged jail that has the explicit purpose of depriving practitioners of their personal freedom. It is not "living at a residence under surveillance," but an illegal detention center where people are tortured.

    b). Serious prolonged detention

    The time between the approval of arrest for these three practitioners on February 21, 2003, and their public prosecution on December 15, 2003, was ten months and four days. This constituted a serious case of "Prolonged Detention."

    "Prolonged detention" refers to violating the legal limits of detention allowed during the process of investigating, examining, prosecuting and trying cases by continually detaining suspected criminals. Article 124 of the "Criminal Law Procedure" stipulates, "The detention of suspected criminals for investigation after their arrest shall not exceed two months. In complicated cases, if at the end of this period the case still is not complete, the period of detention may be extended for one more month with the approval of the Higher People's Procuratorate." Article 126 stipulates that for major and complicated cases, or cases requiring collection of evidence in the remote areas, the period may be extended for another two months beyond the period allowed in Article 124. According to these articles, the maximum period of detention should not exceed seven months. It took the Chaoyang District People's Procuratorate more than ten months, however, between the approval of arrest and public prosecution. This constituted an act of serious and illegal prolonged detention.

    c). On the issue of legal trial procedures and extending the time allowed to pronounce judgment

    Article 151 of the "Criminal Law Procedure" stipulates: "After the people's court decides to hold a hearing it must do the following: (5) For an open trial case, it must make public three days before the hearing the name of the accused, the date and the venue of the hearing."

    The Chaoyang District Court announced the open trial and published the date and the venue. By changing the venue one day before the hearing, however, it is evident that this court was perpetrating some sort of deception. The court began the trial on January 9, 2004, and pronounced its judgment on April 22. The duration was three months and thirteen days. Article 168 stipulates: "When the people's court tries a case, it should pronounce its verdict within one month, and at the latest within no more than one and a half months. If it fits one of the conditions stated in Article 126 [of the "Criminal Law Procedure"], the pronouncement of the verdict can be delayed for another month, but only with the approval or a decision by the provincial, municipal or autonomous region's High People's Court." Based on the two extensions of this article, the pronouncement should be made within two and a half months at most. It took the Chaoyang District People's Court, however, three and a half months from the beginning of the trial to the pronouncement of the verdict. This is a serious violation of legal trial procedures.

    d). About the corroboration of the evidence on which the conviction was based, and the issue of legal basis

    This is the key issue of these cases. The unlawful practices that the three people were accused of and charged with by the Chaoyang District People's Procuratorate during the trial by the People's Court were:

    During the period from May 2001, to August 2002, while Chu Tong and Yu Chao were staying at Wang Weiyu's residence, Chu Tong wrote the following articles: "The Facts About the Persecution of Falun Gong Practitioners at the Beijing Municipal Management and Education House of Juvenile Delinquents," "The Impossibility of Group Suicide in Wanjia Forced Labor Camp: My Experiences in Jail," "A Letter to Prison Guards by a Falun Dafa Practitioner," "Tsinghua University Lecturer Chu Tong Recalls Her One-and-a-Half Year Imprisonment, and a Discussion on the 'Transformation' of Teng Chunyan," "A Letter from a Young Mother to Her Friends," "In Memory of Zhao Ming," "Outcry of the People from Tsinghua," "Celebration of Life," "The Beauty of the Spring," "Nothing Can Cover the Truth, and Justice Shines," "'Transformation' Is Cruel Mental Torture," as well as the article "Records of the Persecution of Tsinghua Students for Practicing Falun Gong," which was co-authored with Wang Weiyu. Yu Chao and Wang Weiyu distributed these articles on the Internet. Based on the above-mentioned facts, the People's Court affirms that Chu Tong, Yu Chao and Wang Weiyu continued to use the Internet to spread information and be involved in the activities of the Falun Gong Cult despite the People's Congress Standing Committee's "Decision on Banning the Evil Cult Organization, Guarding Against and Punishing the Activities of the Evil Cult." The acts of these three people violated the criminal law, and they are guilty of using the evil cult organization to violate the enforcement of the law. In accordance with the Article No. 300 of the "Criminal Law" and its "Interpretation of Certain Problems in Implementing the Law in Dealing with Cases of Organizing or Utilizing Evil Cult Organizations to Commit Crimes, Article 2" (hereafter abbreviated as the "Interpretation"). The court sentences Chu Tong to eleven years imprisonment, Yu Chao to nine years and Wang Weiyu to eight years.

    Based on the above verdict we have the following questions:

    i). The facts of the "crimes" of these three people cannot even be established

    To decide if someone has violated the law or committed crimes, the prerequisite is to check if his motivation and aim would endanger society or other people's interests, and to check his actual conduct. It is required to see if the true nature and contents of the conduct would be contrary to social ethics and collective or individual interests. This is the purpose of legislation, and the basic principle for the handling of a case by the judicial organs. The "facts of crime" of Chu Tong, Yu Chao and Wang Weiyu handed down by the Chaoyang District People's Court in Beijing are nothing but a series of articles they wrote and distributed using the computer. Actually, as far as distributing their own articles is concerned, it is irreproachable. It is just like writing and spreading any other works of literature, or scientific and technological theses. No matter what area the articles touched upon, the most important issue is whether the content was objective and true. The above-mentioned articles were all based on their personal experiences and honest thoughts. They just wanted to voice their discontent and protest the injustice they had experienced, or to express their expectations. What's wrong with that? Why didn't the court investigate and examine the objectivity and truthfulness of the issues raised in these articles? By disregarding the facts, motives and aims of the three accused, the court, using the inference of external factors forced upon it, adopted the formula of thinking: "Making an appeal is violating the law; exposing the persecution of Falun Dafa is violating the law; and promoting Truthfulness, Compassion and Forbearance is violating the law." Using this twisted logic, anyone doing these things would be declared guilty. This is a reflection of the degenerate judiciary system of the Chinese Communist Party.

    ii). In defining the nature of the "crimes" of the three people, the Chaoyang District Court made a mistake in applying the law.

    The verdict reads: "The accused: Chu Tong, Yu Chao and Wang Weiyu have disregarded the country's laws. After the country had proscribed Falun Gong by formal decree to be a cult, they still used ... to continue to carry out Falun Gong xxx activities; ... after the People's Congress' Standing Committee made public its stance, they continued to use ... to carry out Falun Gong activities..." The question is, which decree formally proscribed Falun Gong as a cult? Why didn't the court explicitly point that out? As a matter of fact, the declared stance has never mentioned Falun Gong, and, up to this point in time, there are neither any legal procedures nor any legal documents affirming Falun Gong as a cult. The only thing concrete is the circular describing how to carry out the "interpretation" by the Standing Committee, as well as legal interpretations by the Supreme Court and the Supreme Procuratorate, in which it instructed to "resolutely crack down on Falun Gong." This is illegally exceeding their powers, because these two bodies' internal documents do not constitute the law.

    The entire process used by the Chaoyang District Court of Beijing to try and deliver heavy sentences against Chu Tong, Yu Chao and Wang Weiyu was seriously flawed. Their arrest, prolonged detention, public prosecution and trial were based on unlawful applications of the law. None of the definitions of the nature of the "crimes", the investigation, the evidence, and the application of the laws followed proper procedures. This is a typical example of the Chinese Communist Party illegally manipulating the legal system in the persecution Falun Gong.

    Note:

    (1) Dead Person's Bed: The four limbs of the practitioner are stretched out and tied to the four corners of an icy-cold metal bed. The practitioner cannot move at all. Neither is he allowed to get up to eat, drink, or go to the bathroom. This treatment would last from several hours up to more than a dozen days.     Ms. Liu Yunxiang Suffers Two Miscarriages After Beatings by Local Authorities

    Led by the former township Secretary of Politics and Law Hua Guangyong, the authorities at Junbukou Township of Weifang City in Shandong Province arrested Ms. Liu Yunxiang in the winter of 1999. She is a Falun Dafa practitioner from Yangjiazhuang Village, Junbukou Township. They imprisoned, beat, and tortured her until she had a miscarriage. In the summer of 2001, the local authorities, including Mayor Gao Zhongde, Deputy Mayor Dai Qingjun, and Director of the Township Justice Department Xia Bingtang, once again arrested Ms. Liu and beat her until she suffered a second miscarriage.

    On December 15 and 16 of 1999 (lunar calendar), the township secretary of politics and law ordered the arrest, rounding up and torturing Falun Dafa practitioners who refused to give up their practice. It was freezing outside, but they still forced practitioners to shovel snow while wearing little clothing. Afterwards, they forced the practitioners to stand in the snow, and then beat and kicked them. After breaking a few sticks as part of the beating, they used belts to beat the practitioners. They even forced practitioners to hit each other, even forcing male practitioners to strike the hips of female practitioners.

    During the imprisonment, the director of the local justice department Xia Bingtang forced practitioners to run three times a day. In each one-hour run, the practitioners were forced to curse the founder of Falun Dafa. Those who refused to curse or ran too slowly were beaten with wooden sticks. After the run, they forced the practitioners to drink alcohol and smoke cigarettes, actions that are against Falun Dafa principles. As a result of the beatings, 32-year-old Ms. Liu Yunxiang from Yangjiazhuang Village had a miscarriage. In addition, Ms. Liu Xizhen was beaten so severely that her skin was torn and her flesh exposed. For the next few days, her torn skin was stuck to her clothes. Three times Gao Minggang poured boiling water into a cup and scalded Ms. Liu Xizhen's hands. At night, they forced the practitioners to sit on the freezing concrete floor and deprived them of sleep. After they fined each practitioner 4,000-6,000 yuan, they released the practitioners on December 20.

    On a summer night of 2001, right after the wheat harvest season, Gao Zhongde, Dai Qingjun, Xia Bingtang, Liu Zhongjie, Wang Lican, Zhang Lianhai, two women surnamed Hu and Ji, and thugs Sun Qingyu, Wang Jinzhong, Cao Xiqin, and Wu Jifang arrested a number of Falun Gong practitioners and took them to the municipal building for torture. They again kicked, beat, and shocked the practitioners with electric batons. They beat Ms. Liu Yunxiang, which caused another miscarriage. They also knocked Ms. Wang Rongxiang unconscious, and she was taken to the emergency room at the Junbukou Hospital. In addition, they repeatedly shocked Ms. Liu Xizhen with the electric batons until she fell unconscious. Then they poured cold water on her and continued to shock her until she was covered with injuries.

    After twenty days of torture, all of the practitioners except Ms. Liu Rongxiang, who was severely injured, and Ms. Liu Yunxiang, who had a second miscarriage as a result of the torture, were sent to a detention center to be imprisoned for another month. Then the authorities sent them back to the township for further torture until they finally released the practitioners twenty days later. The practitioners who were persecuted during these two incidents include Ms. Wang Xiuhua, Ms. Sun Ruiying, Ms. Cao Xiaohong, Ms. Cao Xiaomei, Ms. Wu Xuehong, Ms. Liu Xizhen, Mr. Liu Xiangjun, Mr. Liu Xifu, and Mr. Liu Mingxiang.


    Arrested and Mercilessly Beaten by Multiple Policemen for Upholding My Belief in Falun Dafa

    My name is Niu Ruiping, and I am 49 years old. I live in Tangshan City, Hebei Province. I have dedicated myself to living in accordance with "Truthfulness, Compassion and Tolerance," and to being a good person in any situation.

    On March 6, 2005, I went door to door to clarify the truth and arrived at the gates of Zhu Guihua's house. At around 2 p.m. in the afternoon, the Guye district's new village resident committee director along with the Guye district police station chief Xiao Zhongguo and another policeman barged into Zhu Guihua's house. Without showing any papers, they started to search the home. They confiscated many lecture books, CDs, and Clearwisdom weekly magazines. Xiao Zhongguo asked me for my name. I thought to myself that I should have the freedom of going door to door, so I thus did not cooperate with them and did not give them my name.

    In the afternoon on the same day, Xiao Zhongguo and two policemen took me to the Guye police station for interrogation. They asked me what my name was. I did not answer. Seven or eight policemen, under orders from Zhang Shuhua and Xiao Zhongguo, promptly took turns beating me. Two of them twisted my arms; one pulled my hair. The station chief Zhang Shuhua slapped me countless times. Xiao Zhongguo did not hesitate to kick me many times as well. Policeman Li Mengjun used his shoes to hit my cheeks. They told me during the interrogation, "We are the machines of the CCP. If the CCP has us beat you then we will beat you." They also said that if the CCP orders them kill people, they would do it, because the CCP will give them money. They had no trouble getting my mouth to bleed during the beatings. As I used my hand to wipe the blood away, they forced my hand away from my mouth. They beat me to the point where I became dizzy and lost my eyesight. My eyes and mouth were all swollen. They pulled a large amount of my hair out of my scalp as well. When I used my hands to brush my hair back, I picked up some hair in my hand. One officer snatched the hair I had picked up right out of my hand, in a vain attempt to hide the evidence. There were two policemen who used sharp sticks to pinch my fingertips. Another policeman wore heavy boots and forcefully stepped on my feet. The 58-year-old Zhu Guihua and Chen Xiuxia, who were taken at the same time as I was, were beaten as well. Their hair was also pulled out, and their faces and heads were all swollen from the beatings.

    After a while, the policemen brought me to another room. I continued to refuse to cooperate with them. This made them angry and they started twisting my arms, and beating me mercilessly with floor sweeping brooms. My hands were very swollen from all the hitting and my whole body was bruised with green and purple wounds. When they were done with me, they locked me in a cell, and because I couldn't see properly, I had trouble even walking to the toilet. No one paid attention to my suffering.

    On the morning of March 7, after finding out who I was, the 1st section chief, Liu Zheng, ordered the Guye police station policemen, secretary Liu Zengguang of the neighboring workplace, Wang Minzhong from the public safety sector, and two resident committee chairmen to search and ransack my home. They confiscated a set of lecture CDs, and five truth clarifying posters.

    On the evening of March 7, the Guye police took me to a detention center. On the afternoon of March 8, I suddenly had a dizzy spell and found that my heart was beating way too fast. The detention center director Zhao called the Public Security Bureau chief, and then contacted the Guye police station. Then they brought me to the Guye district hospital for an examination. The found that my blood pressure was around 200 which was the result of being beaten on March 6, after which I almost never slept, and I vomited every time I ate or drank something.

    On March 10, after seeing me vomit again after eating very little, director Zhao brought me to the Guye district hospital again that afternoon. My blood pressure was still around 200. The pupil in my left eye was externally damaged and enlarged. The insides of both of my eyes were also very blurry, light didn't seem to go through straight, and my right cornea was swollen. On the evening of March 10, the detention center director released me to go home. After I arrived at my house, the Guye district police station dispatched four people and put me under surveillance 24 hours a day.



    Summary of Other Articles and News - May 18, 2005

    Perpetrators in Daqing City Prison intensify persecution of Falun Gong practitioners

    After the May 1 holidays, Jiang Shuchen, the deputy head in charge of persecuting Falun Gong at Daqing Prison, and Guo Chuntang, head of the Education and Reform Section and also the head of Daqing Prison's 610 Office, started another round of persecution. They announced that practitioners who hold hunger strikes to resist the persecution would be force-fed corn porridge every two or three days. On May 12, practitioners Zhu Hongbing and Cheng Peiming, who were being illegally held in the Infirmary Division, were stripped of their clothes and forced to wear inmate uniforms. They were tied up for one day. On May 15, Zhu Rui, head of Division 3, and Zhang Guosong, deputy division head, tied up practitioner Wang Yufeng in the instruction room for 24 hours.

    Personnel from the Chaoyang District Political and Judiciary Committee and the Qinghe Police Station in Changchun City arrest practitioner Mr. Chen Chengyuan

    On May 12, 2005, practitioner Mr. Chen Chengyuan and his parents-in-law went to the Heizuizi Women's Prison to visit Mr. Chen's wife Yan Huawei, who had been illegally sentenced to nine years in prison. Qinghe Police Station police officers arrested all three and subsequently ransacked their home. Personnel from the Chaoyang District Political and Judiciary Committee and from the Qinghe Police Station had planned the abductions in advance. Mr. Chen Chengyuan was savagely beaten and is currently being held at the Daguang Detention Center. His mother-in-law was released that night.

    Practitioner Mr. Zhou Youfu in Ruichang City, Jiangxi Province, suffered a mental collapse from persecution at the Jiujiang City Forced Labor Camp

    Practitioner Mr. Zhou Youfu, 50 years old, was an employee at the Ruijiang City Textile Factory in Jiangxi Province. After the persecution started on July 20, 1999, he was detained. He was first sent to a brainwashing class and later to the Jiujiang City Forced Labor Camp, where he was brutally tortured. He suffered a mental collapse and has not yet recovered.
