(Clearwisdom.net) The Communist regime uses Article 300 of the Criminal Law to frame Falun Gong practitioners, kindhearted people who believe in "Truth-Compassion-Tolerance." Article 300 refers to "utilizing evil religious organizations to undermine the implementation of the law." What evil religion? What crimes have been committed? What law has been undermined? Who is actually trampling upon the law?
1. It is against the law to persecute a spiritual practice using the charge of "evil religion." Freedom of belief is recognized as a basic human right worldwide. Does a government have the right or the need to define a belief as "evil religion?" Didn't they label this belief as "evil religion" with the intent of crushing it? Where is the freedom of belief then?
The laws in democratic countries do not define any religion as "evil religion." The law cannot constrain the cause of people's thoughts; it can only be applied to the result of people's actions and behaviors. People can make their own judgment as to whether a religion is "good" or "evil." An evil religion won't have its market, and a righteous belief cannot be suppressed.
The persecution of Falun Gong has been going on for nearly eight years, yet it has spread from ten to more than 80 countries. Is this the issue that the Communist regime can't handle? The act of defining a belief as "evil religion" is itself a violation of human rights, and that, in fact is what is "undermining the implementation of the law .
2. The charge "evil religion" does not stand. It is against the freedom of belief in the Constitution. High-ranking CCP officials who know the inside story are all clearly aware that it was Jiang Zemin alone who invented the charge "evil religion" against Falun Gong. He casually called Falun Gong an "evil religion" during an interview with a French reporter in October 1999 when he visited France. The next day, the People's Daily published an article entitled "Falun Gong Is an Evil Religion." The term "evil religion" was thus made up like this. Jiang labeling Falun Gong as an "evil religion" was his individual act, not the result of any rational or legal process. Persecuting Falun Gong practitioners based on this charge shows that Jiang Zemin has used his power to undermine the implementation of the law. All the trials and sentences against Falun Gong practitioners are illegal. However, practitioners' actions to expose the CCP's illegal behavior are labeled as "obstructing implementation of the law" or "getting involved in politics."
Of course, it was impossible to define Falun Gong as an "evil religion" by means of any lawful process. Before the persecution started in 1999, Luo Gan ordered the Department of Public Security to investigate and collect "criminal evidence" all over the country. But the two big nationwide initiatives Luo Gan ordered came up with no criminal evidence. A high-ranking official said, "Falun Gong has hundreds of benefits for the people and the country, but no single harm." Out of jealousy--the number of Falun Gong practitioners is larger than the number of CCP members - Jiang Zemin violated the law with his abuse of power, did not hesitate to take the lead to "undermine the implementation of the law" and define Falun Gong as an "evil religion." Some time later, Jiang contrived the self-immolation incident on Tiananmen Square to deceive the public so that he could escalate the persecution of Falun Gong.
3. The law created to suppress Falun Gong deliberately confuses and deceives the public.
(1) Laws can punish one's illegal actions, but not one's thoughts. In China, however, one can be found "guilty" for his "thoughts" and "beliefs." One can be charged and sent to a labor camp for possessing a copy of Zhuan Falun. By saying "I will still practice Falun Gong," one might be arrested and sent to a brainwashing center or sentenced to forced labor or a jail term, then tortured and brainwashed, so called "reformation." Thousands of people have been persecuted to death this way, yet the Communist regime calls this "education and influence." According to the Criminal Law, punishing a person for his belief is committing at least "the crime of abuse of power," "the crime of illegal detention," "the crime of illegally depriving a citizen of freedom of religion" and "the crime of torturing detained citizens."
(2) The charge "undermining the implementation of law by using evil religious organizations" attacks one's beliefs, not one's actions. Falun Gong practitioners have never undermined any law. They follow the teaching of "Truthfulness-Compassion-Forbearance," try to be good people in society, and improve their minds and bodies. How could they violate the law? How could they "undermine the implementation of law?" During all the trials of Falun Gong practitioners, no one has ever proven that Falun Gong practitioners are harmful to society. Actually, many people started practicing Falun Gong after learning the truth about Falun Gong.
No law in China states that "believing in Falun Gong is against the law;" no one dares to do so because Falun Gong practitioners walk on a righteous path. The only document suggesting that practicing Falun Gong is against the law is the "Six Prohibitions Notice" announced by the Ministry of Public Security. The six prohibitions include: prohibit Falun Gong practitioners from studying Falun Gong books, practicing the exercises in parks, getting together to share their experiences, and appealing to the government for justice. Anyone who violates the notice will be detained or charged with criminal responsibility. Later on, under orders and threats from Jiang's regime, the Supreme Court and the Supreme Procuratorate used the "Decision of the Standing Committee of the National People's Congress" to punish Falun Gong as a cult. Such judicial interpretation without a legal basis is itself against the law and therefore is invalid.
China is the only country worldwide where "thoughts" and "belief" can be "guilty" and the belief in "Truthfulness-Compassion-Forbearance" is subject to suppression.
In today's China, police and judges are still using the "Six Prohibitions" and Article 300 of the Criminal Law as the "legal basis" to unscrupulously arrest Falun Gong practitioners, send them to forced labor camps and sentence them the jail terms. Shouldn't these actions be condemned?
