Attorney Not Allowed to Defend Falun Gong Practitioner

(Minghui.org) In a recent trial, the court would not allow Mr. Yan Jinyou's attorney to defend him. Mr. Yan refused to accept the court-appointed attorney, which meant the trial had to be postponed.

Mr. Yan, in his 60s, was arrested along with his wife and two neighbors on November 29, 2013. All of them are Falun Gong practitioners. The Changchun police ransacked his home, confiscating 600 calendars and more than 100 brochures with information about Falun Gong. The police also took office equipment including five printers, two paper cutters, a plastic sealer, printing materials, and 4,800 yuan in cash.

Mr. Yan's wife and neighbors were released a few weeks later, but Mr. Yan remained at the Changchun First Detention Center. His case was submitted to the Procuratorate and then to the court. Mr. Yan's family hired an attorney to defend him.

The trial was scheduled for 5:30 a.m. on December 12, 2014 in the Kuancheng District Court in Changchun City. The only evidence provided by the prosecutor were the calendars and printing machines found in Mr. Yan's home.

When it became clear that the attorney hired by Mr. Yan's family intended to enter a not-guilty plea, the court would not allow him to represent Mr. Yan. Knowing that a court-appointed attorney would enter a guilty plea, Mr. Yan refused to go forward without his own attorney, effectively bringing the proceedings to a standstill.

After the trial was halted, Mr. Yan developed severe symptoms of hypertension and cardiac disease. He is being treated in Xinkang Hospital, which is part of the Jilin Prison Management system.
