Elderly Practitioner from Chongqing Writes Letter of Accusation after Illegal Eight-month Detention

(Minghui.org) Mr. Dai Dakui, 72, from Chongqing, was sentenced to five years in prison in 2003 for making a truth-clarification banner. He was persecuted in a brainwashing center twice after being released from prison. On April 16, 2012, Mr. Dai was once again arrested and his home was ransacked. He was persecuted in a brainwashing center for a month and was then taken to a detention center. On October 16, 2012, he was tried Yongchuan Court.

Mr. Dai represented himself and pled “not guilty.” He stated that he had broken no laws, had only done good things and was in fact saving people. He was simply exercising his rights to "freedom of speech, freedom of the press, and freedom of religious belief" which are stipulated in Articles 35 and 36 of the Constitution of the People's Republic of China.

Mr. Dai protested his illegal detention and maltreatment in an official letter of accusation, addressed to the government staff and police officers who were involved in his arrest:

Letter of Accusation

I am Dai Dakui, male, 71 years old. My home address is No. 316, Building 18, Yupingbei Road,

Victory Office in the Yongchuan District, Chongqing. My wife and I were arrested by officers from the Xuanhua Police Station and the National Security Division of the Petroleum Company on April 16, 2012, because we practice Falun Gong. On April 26, the National Security Division detained us on "suspicion of using a cult organization to undermine law enforcement." My wife, Wu Yanqiong, was sent home for medical treatment because she fell in the detention center. I am currently in the Yongchuan Detention Center.

The reasons for this accusation are:

1. It was illegal for the petroleum company, the local community, the Xuanhua Police Station, and the National Security Division of the Police Department to break into my home, arrest me, and search my home.

Article 36 of the Constitution states that "citizens have freedom of belief." However, around 7 a.m. on April 16, 2012, the petroleum company, the local community staff, the Xuanhua Police Station and the National Security Division of the Police Department broke into my home, without a search warrant or any valid ID. They arrested me and my wife and took us to the Taohuayuan Brainwashing Center in Huangguashan, because I practice Falun Gong. They also confiscated my personal belongings, including one printer, two computers (one of them is for my grandson to play computer games on), pictures of Master Li Hongzhi, and several yuan notes with truth-clarification messages printed on them. According to criminal law, these acts constitute unlawful search, illegal intrusion into a residence, and unlawful deprivation of citizens' freedom of religious belief.

2. Falun Gong is an upstanding Great Law.

Falun Gong was founded by Mr. Li Hongzhi and is a high-level cultivation practice of the Buddha School. In 1992, Mr. Li first taught Falun Dafa publicly in the city of Changchun, Beijing, and then continued to give lectures all across the country. Practitioners are required conduct themselves according to Truthfulness-Benevolence-Forbearance, to look inward whenever there is a conflict, and to consider others' feelings first. It directly targets the mind and improves one's moral standard. The exercises keep the body healthy and fit.

On March 13, 1995, Mr. Li Hongzhi held the first overseas Qigong seminar in France, invited by the cultural center of the Chinese Embassy in France, to introduce Falun Gong into Western countries. Now Falun Gong has been embraced in more than one hundred countries around the world. In Hong Kong, Macao, and Taiwan, there are hundreds of thousands of people practicing Falun Gong. Falun Gong's main book, Zhuan Falun, has been translated into over 38 languages and is published all over the world. It has been officially recognized by overseas governments over 1,000 times.

In September of 1998, the State Sports Bureau conducted a survey of over 12,553 Falun Gong practitioners. Based on questions concerning Falun Gong's efficacy in healing and health maintenance, it was found that the complete recovery rate of those practitioners was 77.5 %. People with improved but not yet completely recovered health conditions accounted for 20.4 %. Therefore, the total rate of healing and fitness improvement was found to be 97.9 %. The average annual savings on medical expenses for each person is about 1,700 yuan. The total savings on medical expenses due to the practice of Falun Gong totals 21 million yuan each year. Besides the survey in Changchun, similar survey results were found in Beijing, Guangzhou, and Harbin. Falun Gong is very effective in healing and maintaining fitness and it is beneficial to society.

Article 36 of the Constitution states: "No state government, public organization, or individual may compel citizens to believe in religion or no religion, nor may they discriminate against citizens or non-religious citizens of religious belief." It is not legal for Jiang Zemin to say that Falun Gong is an evil cult and it is certainly not based on fact. It is just an excuse to use the state machinery to carry out the persecution against Falun Gong.

In summary, Falun Dafa is a righteous Fa.

3. Falun Gong does not undermine the implementation of national laws or administrative regulations.

There are two legal documents used by prosecutors and the secretary to justify the judicial proceedings of administrative regulations and implement the penalties against Falun Gong. The first is the “Resolution of the Standing Committee of the National People's Congress of the People's Republic of China on Banning Heretic Cult Organizations, Guarding against and Punishing Heretic Cult Activities.”

The second is the Ministry of Public Security's "Announcement" (Document [2000] no. 39), which listed 14 cult organizations. The General Office of the CPC Central Committee and the State Council General Office documents expressly listed seven cult organizations. Falun Gong is not among them.

Therefore, according to the law that was enacted by the CCP itself, Falun Gong is not a cult, let alone does it undermine the implementation of national laws or administrative regulations.

I work for a petroleum company. In the 1960s, to defend the country, people's lives, and property, over 20 co-workers and I risked our lives to rescue the 32111 drilling crew, which was threatened by fire. We got a chance to meet with the state leaders afterwards. Having worked for decades in the petroleum industry, I suffered from various diseases. I started practicing Falun Gong practice just before I retired and my diseases quickly disappeared. However, I have endured repeated unfair treatment under the persecution of Falun Gong. I was subjected to brainwashing attempts multiple times and was sentenced to five years in prison and endured severe mental and physical injury. My pension was also reduced many times. (My wife doesn't work and has no income.) After my wife fell and was injured, the medical expenses were over 20,000 yuan, out of our own pocket. We couldn't afford any more. Falun Gong is good, and Truthfulness-Benevolence-Forbearance is good. It is deeply rooted in 5,000 years of traditional Chinese culture. We should cherish it because it will for sure lead to the great rejuvenation of the Chinese nation during this great historic period of change, and it will benefit the future generations of mankind.

Law is the symbol of fairness and justice in the world. Religious freedom is a basic human right. Faith and innocence is basic to humanity. I hope that my complaint will get your attention and help. I hope that you will extend the hand of justice and truly, “Protect the innocent from criminal liability” and set me free. In fact, helping others is actually helping yourself.
