  • Mr. Bu Dongwei Sentenced to Two and One Half Years of Forced Labor Based on Fabricated Evidence

    On the evening of May 19, 2006, Haidian District Police Department arrested Mr. Bu Dongwei, a Falun Gong practitioner from Haidian Distrct, Beijing City. As a staff member of the Beijing office of the U.S. Asia Foundation, Mr. Bu Dongwei was responsible for providing legal assistance and counseling for farm workers at the U.S. Asia Foundation. This young man is well recognized for his kindness and honesty. The heavy workload at his job and at home meant that he rarely had the opportunity to get out and be in touch with the outside world.

    On August 15, Mr. Bu's family received a "Statement of Reeducation through Labor" from the Legal System of Haidian District Police Department, Beijing City. The statement claims Bu Dongwei had hidden 80 copies of so-called Falun Gong "propaganda material" and thus was sentenced to two and one half years of forced labor. His family stated that they had only had several copies of Zhuan Falun and the "Minghui Weekly," and didn't have any other materials. Also, when the security personnel made the arrest, they had only asked Bu Dongwei to turn in the Nine Commentaries on the Communist Party without mentioning anything about the so-called Falun Gong "propaganda materials."

    There are many reported cases of Falun Gong practitioners being arrested based upon fabricated evidence contrived by Chinese Communist Party (CCP) law enforcement offices. Analysts point out that when the CCP arrest people like Bu Dongwei, there is an internal policy or special arrangements made to persecute Falun Gong practitioners as soon as possible. Since the CCP Central Committee formulates the persecution policy of Falun Gong, many executors consider it is natural to have this type of law violation.

    Below is an appeal document written by Bu Dongwei's wife. The document was submitted to the Reappraisal Section, Legal System Office, Beijing City People Government: 86-10-65193457, post code: 100744.

    Besides administrative reappraisal, the party concerned can also pursue administrative law and sue in court.

    Appeal Document

    Applicant: Bu Dongwei, male, 36, a staff member of the Beijing Office of the U.S. Asia Foundation

    Agent: Lou Hongwei, female, 37, Bu Dongwei's wife

    Re-appraiser: The Re-Education through Labor Management Committee, Beijing City Peoples' Government (to be abbreviated as the Committee below)

    Request of appeal: Revoke the mistake stated in the "Statement of reeducation through labor" by the Committee and protect the legal rights of the appealer.

    Our family received the "Statement of reeducation through labor" on August 15 (2006 Beijing Labor Trial No. 2654) sent by the Legal System Section of Haidian District Police Department, Beijing City. After careful study of the statement, I decided to make an appeal for Bu Dongwei. Below are statement of the facts and reasons:

    The Statement "Violating the Law" is Not Consistent with the Facts

    The accuracy of fact considered by the litigant is the crux of determining penalty. The statement indicates the "fact of law violation" by Bu Dongwei as: Haidian District Police Department claimed they found Bu Dongwei to be in possession of 80 copies of Falun Gong "propaganda materials" hidden in his home. This statement is inconsistent with the facts. When I called home on May 20, my parents told me that seven to eight policemen from the Haidina Public Security Branch Bureau came to our home on May 19 and wanted Bu Dongwei to hand over the Nine Commentaries on the Communist Party. They said to Bu Dongwei, "You better hand over the book, otherwise it will be more difficulty for you if we find it." Bu Dongwei replied that he didn't have the book. Personnel from the bureau then said, "Then we'll search!" They didn't find the book after the search. What they found were three copies of Zhuan Falun, two copies of Hong Yin, and several copies of an old Minghui Weekly. They also took away computers belonging to Bu Dongwei and our family.

    Upon hearing the news, I called Ganjiakou Police Station and Xinhuiwuye Company and talked to people who were involved in the arrest. They confirmed the kind and number of materials confiscated from my home. That is to say, the so-called 80 copies of Falun Gong "propaganda material" are nonexistent.

    Besides, the Statement says that Haidian District Police Department firmly believed that Bu Dongwei had hidden 80 copies of Falun Gong "propaganda material" in his home. If that is the case, why did they want him to hand over the Nine Commentaries on the Communist Party, instead of the Falun Gong "propaganda materials" when they made the arrest? And how did they know ahead of time?

    Applicability of Law Article

    The statement claims that sentencing of Bu Dongwei for two years and six months of forced labor was based on Article 13 of the State Department's "Decision of the State Council Regarding the Question of Reeducation Through Labor" and "Trial Implementation Methods for Reeducation through Labor." Rather than exploring whether Article 13 is in conflict with the Constitution of People's Republic of China, or applicable to the decision of penalty, let us review "Trial Implementation Methods for Reeducation through Labor" contained in this article.

    Article 13 states that the time limit of reeducation through labor shall range from one to three years depending on the fact of crime, nature, synopsis, motive, and degree of harm done. The time of the reeducation through labor starts from the day of notification. If the person was taken in for investigation or detention earlier, each day shall be credited.

    Article 13 is obviously an illustrative provision, rather than applicable for determining degree of penalty. I don't know how this article could possibly be used to sentence Bu Dongwei to two years and six months of reeducation-through-labor?

    Unlawful Procedure

    It is against procedure to make an arrest prior to collecting evidence. Neglecting to give family members any written notice or statement of account (the verdict statement is the only written statement), and not allowing Bu Dongwei to consult his lawyer were also unlawful. The date of the verdict statement is June 19, but the family did not receive it until August 15. The delay exceeds the reasonable time according to the law.

    A penalty case must go through an investigation to obtain evidence and certify facts, and give the litigant the right to defend himself before the final verdict can be decided. After the verdict, the litigant has the right to appeal. But Bu Dongwei was deprived of all of these rights. I had called Haidian Public Security several times and pointed out they had seriously violated many procedures. Police who answered the call told me, "If you feel I was violating the law, you can sue me at the higher level office. If you feel that Bu Dongwei's verdict was in error, you can appeal to the Re-Education through Labor Management Committees of Beijing City People Government."

    I hope that between the administrative redress and the administrative suit, that this affair can be conducted in a reasonable and rightful manner.

    Bu Dongwei is a kind person. He has been subsidizing several children associated with Project Hope to go to school and had made donations to the project for planting forests in the western part of the country. His classmates, colleagues and friends all give him high appraisals. He works hard at his job, is responsible to his family, and has never done anything unlawful. He is a benefit to society. If such a person is sentenced to serve forced labor, I think it's unfair in principle.

    Based on the above, I believe that the Committee has violated the principle of law "based on fact and take law as the criterion." I therefore request that the government to revoke the decision of the Committee and maintain the plaintiff's personal freedom and freedom of belief.

    Ding Haiqing's Suffering at Heizuizi Women's Forced Labor Camp in Changchun City

    Falun Gong practitioner Ding Haiqing of Yanbian District, Jilin Province has suffered persecution many times for her belief in Falun Gong. She is currently detained at the Heizuizi Women's Forced Labor Camp in Changchun City.

    Ms. Ding Haiqing was employed at the Wangqing Tianqiaoling Forestry Bureau in Yanbian District, Jilin Province. She was born in 1965. Before she practiced Falun Gong, she suffered from many illnesses and she felt that living in this condition was worse than dying. Her health condition made her irritable and bad-tempered. She did not get along with her mother-in-law at all.

    She began to practice Falun Gong in 1997. Her many illnesses were cured and she became a different person. She behaved according to the principles "Truthfulness, Compassion, Forbearance," and her relationship with her mother-in-law became harmonious. Her mother-in-law told everyone that "Falun Gong is good. If my daughter-in-law had not learned Falun Gong, we would not be on speaking terms." Her colleagues and neighbors also saw the tremendous changes in her after she practiced Falun Gong.

    On July 20, 1999, Jiang Zemin began the brutal persecution of Falun Gong. Ding Haiqing began to tell people the facts and expose the persecution of Falun Gong. She went to Beijing to appeal at the end of 2000. She planned to appeal at the Office of Appeals of the Beijing State Council, but was arrested before she arrived there. Later, staff from Tianqiaoling Forestry Police Department and 610 Office took her back from Beijing. Within a few days, she was sentenced to one year of forced labor, to be served at the Heizuizi Women's Forced Labor Camp in Jilin Province. She was sentenced on fabricated charges. She had to leave a young son and husband at home, who had a difficult time without her.

    Without delay, the police chief Jiang Zhian, political protection section chief Li Yanchun, bureau party committee assistant secretary, politics and judiciary committee secretary, 610 Office chief Zhang Taizhi and many others began to arrest and persecute practitioners. Ding Haiqing was detained at the detention center for half a month. This should have been counted towards her forced labor term, but the corrupt authorities did not count it. After experiencing one year of mental and physical torture in the labor camp, she returned home in January 2002.

    Ding Haiqing clarified the truth and exposed the persecution to everyone she met. Therefore, the local evildoers used every opportunity to persecute her. In July 2003, under the order of Jiang Zhian, Police Chief Li Yanchun, Political Security Section Director Li Yanchun and a group of police arrested Ding Haiqing, and went to her home which they ransacked. Because Ding Haiqing firmly refused to cooperate and loudly exposed the persecution to passersby, over ten police officers beat and kicked her brutally. Many people witnessed the police's atrocities. Later Ding Haiqing managed to escape, and became homeless and destitute to avoid being persecuted.

    This did not stop Ding Haiqing from validating Falun Gong and clarifying the truth. She often spent the entire night outside, all alone. Her feet became tired and often she had no food. The temperature in the winter of northern China sometimes was 20o or 30o below. Her hands and ears were frozen and became very swollen. She slept in the woods of a mountain area during summer and suffered bug bites at night. She visited many villages. Countless kind people warned her to be more careful. Many people with predestined relationships heard about Falun Gong from her, and many who had given up the practice because of the persecution returned to Falun Gong with her help.

    On the night of December 28, 2004, when Ding Haiqing was posting up a sign that read "Falun Dafa is good" in a residential building of Tianqiaoling, she was discovered and taken to the No. 2 Local Police Station. Under the orders of Li Yanchun, political protection section chief, manager Hao Weiliang, deputy director Jiang Tao, policeman Li Wendong and six others inhumanly tortured Ding Haiqing. Two policemen grabbed her head, sat on her and beat her cruelly. Ding Haiqing nearly lost her sight. Her clothing was torn in many places from the torture. They cuffed her hands behind the chair and tied her to the back of the chair. Policemen hit her back with iron clubs, which were wrapped with cloth so as to cause pain without leaving a mark. The pain was excruciating.

    When the police made her sign a document, she wrote "Falun Dafa is good." This resulted in more brutal beating. The police kicked her back fiercely. They did not give her food and force-fed her with mustard oil. After she fainted, the police poured cold water on her (in winter). One policeman even suggested to strip her naked and put her outside, so she would freeze. On the night of 29th, when the police took Ding Haiqing to the detention center, her body was swollen and she was covered with blood. Even the guards in the detention center found it too horrible to look at her. The police feared that her wounds would be seen by others. They detained her at the detention center for about 20 days, until the wounds started to heal. Then they took her to Heizuizi Women's Forced Labor Camp in Changchun City, where she was detained for three years. She was detained at the 7th Group.

    The notorious Heizuizi Women Forced Labor Camp in Changchun City is a hell on earth, and the 7th Group is the most evil place in the labor camp.

    The 7th Group was formed at the end of 2000. They transferred the most vicious guards from other units to the 7th Group. Head Liu Hu forced all Falun Gong practitioners to work long hours doing slave labor, so that he would make a lot of money. If practitioners could not finish the task, they were beaten and cursed at. They treated practitioners as though they were not human beings.

    Group leader Hou Zhihong is one of the worst. He often tortured steadfast Falun Gong practitioners, using many torture methods.

    Clerk Li Man appears to be kind, but is actually very cruel toward steadfast practitioners. Most other police officers are cruel also and aim to break the steadfast practitioners.

    Police officers of the the 7th Group did not allow practitioners to close the restroom door in the cold winter. They claimed that this was the law of the labor camp. Practitioners' hands and feet were frozen and they had difficulty working. They were not allowed to go to the restroom without asking permission, which was not granted when the guards were in a bad mood. Some people just held it in and suffered, while some could not hold it and urinated in their pants. The guards tormented these kind people.

    After Ding Haiqing arrived at the 7th Group, because she firmly refused to "transform", so she also suffered torture.

    Hou Zhihong used all kinds of cruel tactics to make Ding Haiqing "transform," but to no avail. Ding Haiqing remained firm in her belief in Falun Gong. Therefore, Hou Zhihong beat her cruelly. The tortures she suffered included the "flying the airplane" and touching the head to the feet. When she could not reach that position, the guards kicked her, tortured her with electric batons, stabbed her with nails, and hit her hands against the windowsill, injuring her hands. The guards also bought paper and pens with her money. They then made her write "Falun Dafa is good" and fill an entire book every day. She also suffered sleep deprivation if she did not finish what she was told to write. They forced her to stand for 17 hours (from 7 a.m. to midnight) daily without moving.

    One morning, Ding Haiqing loudly shouted "Falun Dafa is good" on the way to cafeteria Therefore, several guards beat and kicked her, and then took her back to the cell, where they tied her on the "dead person's bed" for a week. When she was untied, she was emaciated and had become disfigured. Her cell mates could not recognize her. Because of the torture, she became partially paralyzed. Yet, she was still forced to work. When she did not work, her term was extended. Therefore, her term was extended for over a month.

    However, Ding Haiqing remained steadfast and righteous. The guards at the forced labor continued to torture her mentally and physically even more cruelly. Her family came to see her several times, but only those who were willing to help "transform" her were allowed to see her. During meetings with her family members, the group leader and guards monitored her closely. Within three months, Ding Haiqing completely changed. She used to weigh over 154 lbs. Now she is extremely emaciated. Her eyes are red and swollen. She suffers pain in her chest, heart, lungs and other places on her body. She is critically ill. The guards told her family that because she did not behave well, they would extend her term and take her to a prison.

    Details of the Illegal Arrests of More Than 20 Falun Gong Practitioners from Panjin, Liaoning Province

    On July 22, 2006, more than 20 Falun Gong practitioners were illegally arrested and imprisoned in the Panjin Jail and Detention Center. The perpetrators did not show any credentials when they arrested them and confiscated these Falun Gong practitioners' property. In addition, some of the Falun Gong practitioners' family members were beaten and even arrested. Mr. Zou Liming's daughter was beaten and many places on her body were black and blue; Mr. Zhang Yawei's wife was beaten and his brother-in-law was arrested. At noon on July 22, the police held a banquet at Shaling Town to celebrate their illegal arrest of so many Falun Gong practitioners. Their misdeeds raised enormous public indignation.

    On the morning of July 22, the following practitioners in Panjin City were arrested: Wang Fuxing, Zou Liming, Wang Baofu, Ms. Li (She ran a barber shop. Her husband was also arrested.), Liu Guangqing, Zhao Mingjie, Li Changming, Bai Jinqi, Sun Xiaojing, Ms. Li Hua, Ms. Zhang Chungui, Ms. Yang Liu, Ms. Zheng Yan, Ms. Zhao Dan, and Zhang Cuigui. The homes of these practitioners were ransacked. The other Falun Gong practitioners' names and details are uncertain but are being investigated.

    When the perpetrators went to Zhao Lixin's home to arrest her, she happened not to be home, so they instead arrested her daughter, who had just graduated from college. The perpetrators pried at the door for four hours. It has yet to be determined whether Ms. Zhao's daughter was released or not. Ms. Zhao's husband Mr. Yang Zhifa died several months ago under the long-term persecution. He was destitute and homeless after getting out of a forced labor camp.

    Mr. Liu Guangqing is a teacher at Yulou Professional School of Liaohe Oil Field. When he went home on July 22, he was arrested by Deputy Chief Huang Haiou from the National Security Team in Xinglongtai District, and Gong Qingrong, deputy chief of the Xinglongtai Police Sub-bureau, leading policemen Hou Ming and Duan Yingjie. A total of five people waited at Mr. Liu's home for a long time. The police confiscated his property and stole his personal belongings. Mr. Liu shouted, "Falun Dafa is good!" along the road when he was being taken away by the police.

    Mr. Wang Fuxing is a teacher in Shuangtai District. He was arrested between 8:00 and 9:00 a.m. on July 22.

    Mr. Wang Baofu is a teacher at Panjin Fertilizer Plant Middle School. He went to Qinghai on a business trip and just returned to Panjin not long ago. He lived in Shuagtai District. At 8:30 a.m. on July 22, he was arrested and his home was ransacked.

    Ms. Wang Yuqin is a senior teacher at Panjin Fifth Middle School and is Mr. Wang Baofu's wife.

    Mr. Zhao Mingjie is from Jiuhua (possibly Tuwei Village, Panshan), Panjin. He was illegally arrested on July 22.

    Mr. Zou Liming, from Sanchang, was a former staff person at the Liaohe Oil Field Petrochemical Company. He was terminated from the company. On the morning on July 22, he was arrested at home. The police beat up his daughter during the arrest.

    Li Changming from Jiuhua, Panshan was arrested at home.

    The police also went to Gaosheng Town in Panshan to arrest practitioners on July 22. Because the Falun Gong practitioners they wanted to arrest were not at home, they confiscated their families' property and stole their personal belongings.

    According to the police, they planned to arrest more than 20 people and threatened that they would keep on arresting people. Some local police officers told Falun Gong practitioners not to go outside.

    In this event, Panshan and Shuangtaizi Districts sent out police from the Public Security Sub-bureau, the National Security Bureau, the Liaohe Police Station, the Shengli Police Station, the Jianshe Police Station, and the Hongqi Police Station. Xinglongtai District sent out many police officers led by Deputy Chief Huang Haiou from the National Security Team. The Politics and Law Committee from the city, counties and districts and the 610 Office ("Maintaining Stability Office") directed the arrests.

    This event may have involved the use of people who went astray from Falun Gong to spy on the practitioners to gather information. It was reported that this event was in the planning for more than half a year.

    In addition, these arrested Falun Gong practitioners' family members and relatives went to Panjin Jail and Detention Center, the Politics and Law Committee, National Security, the 610 Office and other relevant agencies to request the unconditional release of their family members.

    Ms. Xu Xiuwen Persecuted by Banan District Detention Center and Yongchuan Prison

    Falun Gong practitioner Ms. Xu Xiuwen in Chongqing City was persecuted because of her steadfast faith in Falun Gong. Police in Nanquan Police Station cruelly tortured her in order to extract a confession. She was later imprisoned in Banan District Detention Center and Yongchuan Prison, and persecuted for three and half years before she was released. Her body was severely injured.

    Ms. Xu Wenxiu is 65 years old and lives at 5 Youth Road, Yuzhong District, Chongqing City. After the CCP began persecuting Falun Gong in July 1999, Ms. Xu went to Beijing to appeal for justice on December 29, 1999. It was then that she was illegally arrested and imprisoned in Liziba Detention Center located in the center of the city for nearly a month.

    Under high pressure from the CCP, Ms. Xu's workplace put her under house arrest for three months, beginning on May 8, 2000. On January 25, 2001, because she made several banners proclaiming "Falun Dafa is Good", Ms. Xu was arrested again by the Nanquan police. The Nanquan Police Station set up a torture room, where the police handcuffed Ms. Xu's hands behind her back. Liu Xianghai, Yang Daibing, and two other officers interrogated, beat, and cursed at her, demanding that she reveal who had encouraged her to make the banners. When Ms. Xu did not answer, the police raised her cuffed hands that were still behind her back, which caused her hands to swell and suffer very badly. They tortured her for several days and nights, denying her food and sleep. After those several days, the handcuffs cut into her flesh. Both of her hands became paralyzed from the persecution, and she has not been able to take care of herself since then.

    Later, Ms. Xu was imprisoned in Banan District Detention Center for a year and a half. She was forced to sleep on the dampest area of ground everyday. When it rained hard, her quilt became so drenched that water could be wrung out of it.

    She was later imprisoned in Yongchuan Women's Prison. After being tortured for so long, she became severely sick. Her lower abdomen swelled and she could not eat, drink, or move. However, the guards still forced her to work. Only after realizing that she was dying did they take her to a hospital for emergency treatment. She was not released until she had been tortured for three and half years, even though she was the caretaker for her 95-year-old mother and her husband, who was almost 80 years old.
