Jilin Veteran to Face Trial for Suing Former Chinese Leader

(Minghui.org) A veteran in Ji’an City is facing trial after being charged with “using a cult organization to undermine implementation of law and violating Article 300 of the Criminal Law,” a standard pretext used by the Chinese communist regime to imprison Falun Gong practitioners for refusing to renounce their faith.

His lawyer found that his case file contained only information about a criminal complaint he had filed against former Chinese leader Jiang Zemin for ordering the persecution of Falun Gong that resulted in his past imprisonment. He was sentenced to 11 years in 2005 for refusing to renounce Falun Gong, a spiritual discipline based on the principle of Truthfulness-Compassion-Forbearance.

Mr. Hu Dawei was arrested at work on December 30, 2016. The police appeared at his home about 10 days later and questioned his wife about his lawsuit against Jiang. The arrest warrant, however, never indicated the reason for his arrest. His wife went to inquire about his case on January 18, 2017, but officer You Siwei declined to tell her what the charge was against her husband.

Mr. Hu’s wife next went to see prosecutor Chen Yongli, who said Mr. Hu had been charged with violating Article 300. She returned to the police station afterwards, and officer You admitted that the police had recommended the charge to the procuratorate. She urged You to stop participating in the persecution of Falun Gong but received threats in response.

The police were still at the Ji’an City Detention Center when Mr. Hu’s wife and his lawyer went to see him one day in February 2017. Mr. Hu revealed that the police had just finished interrogating him and that they tried to get him to confess to crimes he had not committed.

Mr. Hu’s wife and lawyer reviewed his case file at the procuratorate on April 14, 2017. They noted that there were only a few pages, which contained nothing but information about Mr. Hu’s lawsuit against Jiang. The lawyer told the staff that his client had the right to seek justice against Jiang for infringing upon his right to freedom of belief.

The procuratorate forwarded the case to the local court soon afterwards. Mr. Hu is now facing trial.

Background

In 1999, Jiang Zemin, as head of the Chinese Communist Party, overrode other Politburo standing committee members and launched the violent suppression of Falun Gong.

The persecution has led to the deaths of many Falun Gong practitioners over the past 17 years. More have been tortured for their belief and even killed for their organs. Jiang Zemin is directly responsible for the inception and continuation of the brutal persecution.

Under his personal direction, the Chinese Communist Party established an extralegal security organ, the “610 Office,” on June 10, 1999. The organization overrides police forces and the judicial system in carrying out Jiang's directive regarding Falun Gong: to ruin their reputations, cut off their financial resources, and destroy them physically.

Chinese law allows for citizens to be plaintiffs in criminal cases, and many practitioners are now exercising that right to file criminal complaints against the former dictator.
