(Minghui.org) Ms. He Jing, who lives in Tianjin and practices Falun Gong, has been held at Hedong District Detention Center for more than 60 days. This far exceeds the legal detention limit of 30 days. Beyond the 30-day limit, arrest approval must be sought from the Procuratorate. Ms. He's attorney said that her case had not been submitted to the Procuratorate.
Ms. He, 33, was arrested while reading a Falun Gong book with five others in a friend's home on October 18, 2016. The police then ransacked her home and confiscated Falun Gong books and other personal belongings.
Ms. He's mother died in June 2016. Her father is very worried about Ms. He, and went to the police station to request her release. The police said that she was given one month of detention for practicing Falun Gong. Ms. He was not released, however, after a month.
Article 69 of the China Criminal Procedure Law:
If the public security organ deems it necessary to arrest a detainee, it shall, within three days after the detention, submit a request to the Procuratorate for examination and approval. Under special circumstances, the time limit for submitting a request for examination and approval may be extended by one to four days. As to the arrest of a major suspect involved in crimes committed from one place to another, repeatedly, or in a gang, the time limit for submitting a request for examination and approval may be extended to 30 days. The Procuratorate shall decide either to approve or disapprove the arrest within seven days from the date of receiving the written request for approval submitted by a public security organ.
