(Minghui.org) Mr. Liu Jiaze appeared in court for the second time on November 9, 2016, to face charges that he “used a cult organization to undermine law enforcement,” a standard pretext used by the Chinese communist regime in its attempt to frame and imprison Falun Gong practitioners.
Mr. Liu, a Falun Gong practitioner in Shenyang City, Liaoning Province, was arrested on November 3, 2015, for a filing criminal complaint against former Chinese Communist Party leader Jiang Zemin. He has been held in a detention center since his arrest. His weight dropped from 209 to 143 pounds.
The Shenhe District Court held the first hearing on September 28, 2016. The prosecution evidence included his criminal complaint against Jiang and “396 pages of desk calendars” with information about Falun Gong on them that the police confiscated from his home.
Mr. Liu's two lawyers questioned the validity of the 396 “pages of calendars,” and contested whether this ambiguity was intended to make the number of calendars seem larger. After all one daily desk calendar could have 365 pages on its own.
The lawyers asked the prosecutor to show the video of the police's search of their client's home at the next hearing. The prosecutor agreed to do so.
At the second hearing, however, instead of showing the police search video, the prosecutor played a video of the police interrogating Mr. Liu at the police station.
In the video, Mr. Liu told the police that he used to have back and leg problems, as well as knee issues that no medical treatment could cure. After he began practicing Falun Gong in 1998, all of these problems disappeared. Shortly after that, Jiang banned Falun Gong. Many practitioners, including himself, have been persecuted in different ways ever since.
The judge ordered the bailiff to stop the video before it ended.
Mr. Liu's lawyer Li Jinglin again contested the stated number of calendars. The prosecutor replied that they calculated the number of calendars based on pages.
Dong Qianyong, Mr. Liu's other lawyer, argued that neither the calendars with information about Falun Gong nor his client's criminal complaint against Jiang Zemin constituted “undermining law enforcement.” In addition, there is no law that criminalizes Falun Gong. It was Jiang Zemin who ordered the persecution and it was Jiang who violated the law, not his client. The charge against his client, therefore, was not valid.
The judge listened intently and didn't interrupt. The trial ended without a verdict.
