Prosecutor Fails to Provide a Legal Basis During the Trial of a Teacher

(Minghui.org) Falun Dafa practitioner Ms. Qie Lili was tried by the Luquan Court in Hebei Province on August 29, 2013. However, the prosecutor could not provide a legal basis for the charges against Ms. Qie.

Ms. Qie is a teacher at the Xili Primary School in Shijiazhuang, Hebei Province. She was arrested by officers from the Shangzhuang Police Station in Luquan, Shijiazhuang. She has been detained at the Shijiazhuang No. 2 Detention Center.

During the trial, Wang Hao, a prosecutor from the Luquan Procuratorate, charged Ms. Qie with “utilizing a cult to undermine law enforcement.” Her defense attorney asked for evidence, but Wang had no reply.

The attorney then asked for the legal basis of the charge. Wang took out a Supreme Court and Supreme Procuratorate internal circular and started to read it. The attorney subsequently pointed out that the circular was not the law and had no legal authority. Again, Wang was speechless.

The attorney asked the judge to dismiss the case since there was no legal basis, and to release Ms. Qie.

Ms. Qie has been imprisoned nine times since she was first arrested at the age of 21, serving a total of nine years, simply because she practices Falun Gong.
