Mr. Han Chunlong from Shenyang City Suing Over Wrongful Arrest, Forced Confession, and Cruel Treatment

Mr. Han Chunlong, a Falun Gong practitioner from Shenyang City, was arrested on a business trip to Dandong City, Liaoning Province. He was detained and beaten, and a “confession” was forced from him. Mr. Han's family hired a lawyer to appeal on his behalf in Dandong City. They demand that the charge against Mr. Han be dropped, that he be released immediately, and that those responsible be punished for their unlawful and cruel behavior.

Mr. Han is employed at one of the main spectrometer technical support centers in Shenyang City. On December 11, 2012, he went with his colleague, Mr. Chen Xinye, on a business trip to Dandong City and stayed at the Dantie Hotel. Officers from Sidaoqiao Police Station and Dandong City Domestic Security Department went to the hotel and arrested him. He was then beaten and forced to “confess.” The police claimed that they were able to track his e-mails sending out Falun Gong materials through their IP addresses. At Dandong Detention Center, Mr. Han went on a hunger strike to protest. He was handcuffed and put in shackles, then tied to iron rings embedded in the floor. He was force-fed through a nasal tube and catheterized. Both tubes were left in around the clock.

Mr. Han has now lost hearing in one ear and has difficulty walking. His condition is critical. The following is the appeal letter from him, his attorney, and his family.

A. Proper legal procedures have not been followed in Mr. Han's case, and the supervising entities do not intend to made amends.

Demands:

1. Investigate the police officer in charge, Zhang Wei, from Sidaoqiao Police Station, who forced a confession using torture, which is against the law.

2. Find out who in the Dandong City Detention Center force-fed Mr. Han and catheterized him and instruct them not to do such things. Shut down the Dandong City Detention Center.

3. Bring Yu Tiemin, head of Sidaoqiao Police Station, and deputy head Wang Zhi to justice. They deceived Mr. Han's family. They said that they'd talk to the lawyer about bailing Mr. Han out but then refused to see the lawyer, accept his documents, or establish his case, clearly violating the "Code of Criminal Procedure."

4. Require the departments involved to respond to the lawyer's and family members' request for action regarding Mr. Han and Mr. Chen's inhuman treatment.

5. Drop the charge against Mr. Han, immediately release Mr. Han, and compensate him for any losses.

Details:

1. On forced-confession: On December 17, 2012, when Mr. Han came to meet his lawyer, he said: "On December 11, 2012, my colleague Mr. Chen Xinye and I stayed at Dantie Hotel. Between 9 and 10 a.m., police officers arrested me and took me to Sidaoqiao Police Station. They wanted my fingerprints and signature, but I refused to cooperate because I did not do anything illegal. They did not appear to have any legal papers for my fingerprints, just blank paper. A police officer in his 20s slapped me. I was pushed to the ground and then others began beating me.

“I still would not agree to sign anything, so they held my hand and forced me to sign. I was sprayed in the face with something that made my face burn and made me cough. I lost the ability to hear out of my left ear, and still can only detect a constant drumming in that ear. One of my legs is visibly smaller than the other. My chest and back hurt. The young police officer who slapped me is approximately 5 feet 6 inches tall. I would be able to recognize the other police officers involved, if I saw them again.”

On January 8, 2013, Mr. Han met with his lawyer and said: "Today, the police officer that beat me came to interrogate me. He is tall and thin. He asked me if I had ever been sentenced or held in a forced labor camp. I replied that I was sentenced but served my time outside of prison. This person is Zhang Wei, a police officer from Sidaoqiao Police Station.

“Mr. Chen Xinye was slapped in the face by two officers from Sidaoqiao Police Station. They hit him in the chest and kicked him. His family members saw him limping and his face was bruised.”

2. On January 9, Mr. Han met again with the lawyer, who saw that Mr. Han had a tube hanging out of his nose and a catheter. His eyes were full of a gummy substance, and there were leftovers on his eyebrows and other parts of his body from forced-feeding. His hands were handcuffed behind him. From the meeting, he found out that Mr. Han was arrested on December 11, 2012. Mr. Han considered his detention and cruel punishment a criminal act, so he went on a hunger strike. Since December 18, he has been force-fed. A nasal feeding tube and a catheter stays in at all times. People from the detention center watch him around the clock, his four limbs were fixed to different places at all times, and only recently did they take off his shackles.

His lawyer suggested that he not stay on a hunger strike, that it would only hurt him further, but Mr. Han replied that he was innocent and therefore would not eat. He demanded an unconditional release immediately.

3. The lawyer has tried to report his situation to Sidaoqiao Police Station officials and to get in touch with those who are handling his case, but in vain.

On January 9, Zhang Wei met with the lawyer, but he said that he was not familiar with Mr. Han's case, and that any materials the lawyer wanted to submit he should hand over to the head of the police station, Yu Tiemin. When the lawyer wanted to talk to Yu Tiemin, he said he would not meet with the lawyer, nor give him a reason why. Previously, deputy head of the police station Wang Zhi didn't pay attention to him, either. However, since Mr. Han's family members have been talking to the police station to demand Mr. Han's immediate release, both of them said that they wanted to talk to the lawyer. However, when the lawyer came to hand in written proposals to understand the case, both of them refused to see him.

On the morning of January 10, the lawyer finally got hold of Wang Zhi, who briefly told the lawyer about the case and took the documents from the lawyer and Mr. Han's family. However, he did not inform the lawyer on bailing Mr. Han out, which he has asked the lawyer to come talk to him about many times.

We urge the relevant departments to pay attention to Mr. Han's condition, ascertain the facts in accordance with the law, and handle the case in a timely and just manner.

B. Mr. Han's suit against officers from Sidaoqiao Police Station in the Zhenxing District, Dandong City, on his arrest and forced confession

Items:

1. I am suing the officers from Sidaoqiao Police Station of Zhenxing Police Sub-Bureau for arresting me, an innocent man, beating me, and torturing me so that I would “confess.”

2. I am suing police officers from Zhenxing Police Sub-Bureau in Dandong City for taking me to Dandong City Detention Center even though my blood pressure was 191 and my heartbeat was 130 per minute.

Details:

On December 11, 2012, my colleague and I stayed at Dantie Hotel near Dandong Railway Station. Between 9 a.m. and 10 a.m., police officers arrested me and took me to Sidaoqiao Police Station. They wanted my fingerprints and signature on blank sheets of paper, but since I had not committed any crime, I refused. A police officer in his 20s slapped me and pushed me down. Others then beat me. I still would not agree to sign any papers, so they held my hand to try and force me to sign. One of them sprayed my face with a substance that burned my face and caused me to cough. I felt like I was being choked. Ever since then I can no longer hear properly out of my left ear. My chest and back are extremely sore.

The young police officer who slapped my face is approximately 5 ft. 6 inches tall with a slim face and small eyes. I feel certain that I could recognize the other police officers who participated in beating me.

On the evening of December 11, they wanted to take me to the detention center, but could not because of incomplete paperwork. The next day they claimed to have the proper paper work, so at noon they took me to Dandong Detention Center. My blood pressure was in the 191 range and heartbeat 130 per minute. I was still taken to the detention center. At the time of the entry exam I explained to the doctor that I had lost hearing in my left ear, and that one leg was smaller than the other so I limped. The doctor ignored me.

I am an honest man and did not do anything illegal, so I went on a hunger strike. I did not do this to hurt myself, but to resist the persecution. As a result, I was force-fed. At all times, I had a nasal feeding tube, as well as a catheter. My eyes are filled with a gummy substance, and there is a lot of leftover food all over me. Initially my limbs were fixed to the bed when I slept, but recently the shackle was removed at night.

As I already stated, I did not commit a crime. Practicing Falun Gong is not against the law but, rather, a right of every citizen protected by the Constitution. As a child, I was always in poor health. I lacked strength and endurance, had blood in my urine, was pale and often dizzy. I went to many hospitals, and they still have my records on file. It was not until I was grown and began to practice Falun Gong did my illnesses go away. Falun Gong healed me and gave me a new life.

Being on the Internet is not against the law. On the contrary, whoever deprives citizens of their rights are criminals. I told this to the police officers who interrogated me.

I demand to be released immediately. I also ask that the Procuratorate investigate and hold those responsible for arresting and beating me and that I be compensated for this cruelty and my losses.
