(Minghui.org) Officials of the Handan legal agencies have sentenced many Falun Gong practitioners in the past 14 years on the charge of “using a heretical organization to undermine the implementation of law.” Many practitioners have appealed the court's decision, but few cases have been remanded like Ms. Wang Aiying's case.
Ms. Wang Aiying has been tried in court twice, and both times, her case has been remanded. The third trial was scheduled to be held on August 29, 2013, at the Handan Intermediate Court, but it was canceled. Officials at the intermediate court sent the case back to Wuan City Court for a new trial.
Ms. Wang and her husband, Mr. Wang Hongliang, were arrested on the morning of June 1, 2011, by officers from the Chengguan Police Station, the 610 Office, and the Domestic Security Division. The police also ransacked their home and confiscated their personal belongings, including 14,900 yuan in cash, DVDs, a computer, a laminator, a printer, and Falun Dafa books.
Officials at the Wuan Procuratorate filed charges against the couple at the Wuan City No. 1 Criminal Court. Judge Chen Jianguo held a trial and sentenced the couple in February 2012 without notifying their lawyers or family.
The couple's family called the court on March 2, 2012, and was informed that the husband had been sentenced to three years in prison and the wife to four years. According to Chinese law, it is legal to practice Falun Gong in China, but the court officials still illegally sentenced the couple.
Mr. and Ms. Wang filed an appeal to the Handan Intermediate Court and their case was remanded in September 2012, due to “insufficient evidence.” Their case was then transferred to the Wuan City Court No. 2 Criminal Court.
Mr. Wang was later released on bail on February 2, 2013 due to the false charges and support from the international community. Ms. Wang, however, is still detained because several officials of the Wuan Public Security System refused to release her.
Ms. Wang was tried again on March 1, 2013 at the Wuan City Court. After reading the indictment, Prosecutor Yu Weiping provided so-called evidence of a written testimony of what a police officer from Chengguan Police Station had heard five years ago from someone. Ms. Wang's lawyer argued that the testimony only proved that his client was innocent. Prosecutor Yu was at a loss for words and quickly left the courtroom.
Ms. Wang was still sentenced to three years in prison on March 18, 2013. Her family then hired a different lawyer from Beijing and filed another appeal to the Handan Intermediate Court.
An announcement was made in the middle of August 2013, that a third trial was to be held at the No. 2 Criminal Court of the Handan Intermediate Court at about 9 a.m. on August 29, 2013.
Officials at the Handan Intermediate Court tried to have Ms. Wang's lawyer suspended on August 23, 2013, to stop him from representing his client so they could quickly close the case.
During that time, practitioners in Handan clarified the truth about Falun Gong and Ms. Wang's case to the local public and the international community. Under pressure and scrutiny from the public, the Handan Intermediate Court officials canceled the trial on August 29. Ms. Wang's case was remanded again in early September 2013, and a new hearing was to be scheduled.
During the first trial, Judge Chen Jianguo of the No. 1 Criminal Court was afraid to show the contents of the DVDs and fliers confiscated from Ms. Wang's home. He was also rude and often interrupted Ms. Wang's lawyer. Judge Chen ignored the rule of law and the defense's arguments and sentenced Mr. and Ms. Wang to prison without notifying the couple's family or lawyer.
When questioned as to why he didn't inform the couple's family of the sentencing, Judge Chen responded that he was following instructions of his superiors. When Mr. Wang's family called him again in March 2012, Chen rudely said, “Stop calling me! Go talk to the police or officials of the Handan Intermediate Court.”
Officials of the Wuan City Court didn't expect Mr. and Ms. Wang's case to be remanded, yet they didn't repent of their wrongful actions or give up on prosecuting Ms. Wang. In an attempt to achieve their goal, Prosecutor Yu Weiping even provided “new testimony” by a local officer based on what he “had heard” five years ago. Even more ridiculous, Judge Dong Guanghui allowed the testimony.
For the past 14 years, the Chinese Communist Party (CCP) has utilized the Political and Legal Affairs Committee and the 610 Office to control the police and the legal system to persecute practitioners. Judges sentence practitioners based on Item 300 of the Criminal Code, which deals with “using a heretical organization to undermine the implementation of law.” However, the courts have not been able to list any law that has been undermined by Falun Gong practitioners or explain how they have undermined the law.
In fact, many people know that Falun Gong teaches high morals, and that those who learn the practice are able to come and go freely. As such, it is not a cult. It is the CCP that is persecuting people using officers from the public security system and brainwashing people with its media. The Chinese Communist Party is the real cult.
Up until now, no law in China states that Falun Gong is a cult. As the truth about Falun Gong and the Nine Commentaries on the Communist Party spreads, more officers will know that it is lawful to practice Falun Gong and it is illegal to persecute practitioners.
The Chinese regime introduced two documents in August 2013 called, “Public Security Officers Will Be Held Accountable for the Duration of Their Life for the Outcomes of the Cases They Handle ” and “Advisory on Earnestly Preventing Miscarriages of Justice ” that stated: “In order to establish a responsible and just system of handling cases, those who hold positions of authority, such as collegial panels, judges, prosecutors and police, will be held responsible for their behavior during their employment by the state for their entire life. The standards for unjust, false and erroneous cases need to be clarified, and the legal procedures to handle such corruption need to be stated clearly, along with a clear system of punishment for those who commit such acts. Stern actions will be taken against any activities such as extorting confessions by torture, resorting to violence to obtain testimony, or concealing or fabricating evidence.”
This undoubtedly reveals the CCP's intention to completely abandon public security officials who closely follow its policies in persecuting and committing crimes against Falun Gong. In fact, this is exactly how the regime uses the personnel in the public security departments as scapegoats for all of the criminal acts instigated by the CCP itself. People know that Falun Gong is innocent, then shouldn't the judges of the Handan Intermediate Court carefully consider the situation before trying to prosecute Ms. Wang for the third time?
After the announcement of the third trial, the article Are Lawless Judges in Handan City the Latest CCP Scapegoats? , was published on the Minghui website. At the same time, practitioners from Handan and overseas continued to expose the crimes of the CCP and called the officials of the Handan Intermediate Court and Procuratorate to advise them to stop persecuting Ms. Wang and not become the scapegoats of the Chinese regime. The public security officials in Handan became frightened as they didn't want to be held responsible and have their crimes exposed to the public.
Ms. Wang's third trial was thus canceled and the judges at Handan Intermediate Court sent her case back to the Wuan City Court. It was apparent that they didn't want anything to do with the case.
In the 14 years of the CCP's persecution of Falun Gong, many injustices have been carried out. Many officers of the Handan Public Security System know this. Now that the judges of the Handan Intermediate Court have sent back Ms. Wang's case to Wuan, we would like to ask, “Have the judges in Wuan woken up yet?” Is the Wuan City Court still in a position to hold a third trial?”
The Chinese regime is on the verge of collapse and can't maintain the persecution any longer, so it is trying to blame all the crimes committed during the persecution on the judicial system personnel, even though they are directly controlled by the regime.
It is sad that the judges in Wuan are being used as scapegoats without even realizing it. Perhaps they are still unaware that Falun Gong has spread to more than 100 countries and is warmly welcomed all over the world. They should keep in mind that after the cultural revolution ended, the once powerful Beijing City Police Department Chief, Liu Chuanxin, was killed and claimed to have “committed suicide for fear of punishment.” Furthermore, 793 policemen and 17 military officials who had actively followed the CCP's policies were sent to Yunnan Province and secretly executed. Their families, however, were informed that they had died in the line of duty. The “vanguards” of the cultural revolution who managed to escape have all received karmic retribution. Many suffered from heart disease, hemiplegia, or cancer and died a painful death.
In Handan, many people who are actively following the regime's persecution of Falun Gong have received karmic retribution. Li Guihong, former director of the Handan City Police Department, who led the persecution against Falun Gong in Handan, was expelled from the party in 2013. He later suffered from cerebral hemorrhage and needed surgery. Though Li survived, the surgery left him mentally disoriented and he cries all day. Li's wife was also implicated—she suffered a stroke and is now in a vegetative state. Gao Fei of the Handan 610 Office suffers from a rare disease. He was abandoned by the CCP in 2013 and lost his job.
The atrocities committed by the CCP in the past decades have been mounting higher, but no one can escape responsibility for what they have done. The final judgment is near. We would like to earnestly warn the Wuan City Public Security officers and let them know that the right thing to do is to immediately release Ms. Wang and drop her case. The only way to save yourself is to quit the CCP and its affiliated organizations, break away from the party's control, stand up for justice, and expose the CCP's persecution of Falun Gong.
