Mr. Zuo Fusheng Illegally Prosecuted In Fuzhou City, Prohibited from Defending Himself

(Clearwisdom.net) Falun Gong practitioner Mr. Zuo Fusheng was arrested by policemen from the Domestic Security Division of the Fuzhou Police Department. Eight months later, Mr. Zuo was prosecuted by the Cangshan Procuratorate at the Cangshan People's Court. The Cangshan People's Court said that because Mr. Zuo's family members practice Falun Gong, they are prohibited from defending him in court.

Mr. Zuo was taken by a group of policemen led by Lin Feng and Yan Mingkun from the Fuzhou Domestic Security Division on his way to work on January 19, 2011. Mr. Zuo's keys were taken away from him and used by the police to enter his home without a warrant. Mr. Zuo was detained at the Fuzhou First Detention Center.

More than a month later, Mr. Zuo's family brought suit against Lin and Yan for detaining Mr. Zuo beyond the statutory time limit. In April 2011, upon an investigation by lawyers, they found out that the Chinese Communist Party (CCP) had issued a secret arrest order on February 25 without notifying his family members. Mr. Zuo's lawyer soon filed a request, in accordance with Chinese law, asking the court to rectify these illegal actions by the Fuzhou Public Security Bureau Domestic Security Division. Yet, the court has not done anything to date.

Soon after, Lin and Yan began fabricating evidence, adding Mr. Zuo's computer and personal belongings (which were obtained illegally by breaking into Mr. Zuo's home) to the list of “evidence.” Even Mr. Zuo's mother's music CD was included. They further fabricated evidence and included a list in the Procuratorate's statement to the court. Mr. Zuo's lawyer soon filed a defense on behalf of Mr. Zuo, pointing out that such evidence may not be used and that the alleged criminal activities in the statement could not be supported by facts. The attorney stated that since the court was unable to prove Mr. Zuo's culpability beyond a reasonable doubt, Mr. Zuo cannot be found guilty.

However, the Cangshan People's Courts colluded with the Public Security Department and returned the Procuratorate's statement to the Domestic Security Division twice for “further additions to the list of evidence.” On September 30, Mr. Zuo's family learned that that the Cangshan Procuratorate had formally brought charges against Mr. Zuo and its section chief Cao Yongkang has determined that they now have “sufficient evidence” to prosecute.

On September 30, Mr. Zuo's famly members rushed to the court to meet with Judge Cai Wenjian, requesting that they be allowed to defend Mr. Zuo. However, Cai rejected their request on grounds of the fact that Mr. Zuo's family members also practice Falun Gong. When Mr. Zuo's family asked, “Which law or regulation states that Falun Gong practitioners cannot defend their relatives?” Cai stuttered and could not answer.
