Taiwanese Law Professors: Lawsuit Against Jiang Inspires a Sense of Justice and Conscience

(Clearwisdom.net) The Spanish National Court recently indicted former Chinese Communist Party (CCP) head Jiang Zemin and high ranking officials Luo Gan, Bo Xilai, Jia Qingli,n and Wu Guanzheng for genocide and torture in carrying out the persecution of Falun Gong. Professors of law Huang-Chih Chang and Ming-Yang Hsieh at National Taiwan University expressed their positive support regarding the indictments.

In 1999, former CCP head Jiang Zemin singlehandedly instigated the campaign to "eradicate" the spiritual practice of Falun Gong. The genocidal policies of "defame their reputations, bankrupt them financially, destroy them physically, and counting their deaths due to torture as suicide" resulted in large numbers of Falun Gong practitioners being arrested, tortured, beaten to death, and going missing. Many had their organs harvested while they were still alive for the lucrative organ transplant trade. The other four defendants are all Jiang's staunch followers. Falun Gong practitioners around the world have filed more than 50 lawsuits against Jiang Zemin and other chief perpetrators.

Professor Huang-Chih Chang said human rights and respect for life hold the highest position among universal values--there isn't room for negotiation. He looked forward to seeing widespread attention brought to bear on the decision of the Spanish Court and an echoing effect in more countries. When the same charges are filed in more and more countries, especially when the international community shows concern over the same issues, he believes it will go beyond the scope of internal affairs and force the CCP to face the issue of international attention and stop doing as it pleases.

Professor Chang thought a proactive approach would be to tell other countries, "Spain has set an example we hope your country will be able to follow." If most countries told the CCP the persecution was wrong and that it would be sued, an international force would be formed. It wouldn't be a simple issue of the application of law.

Chang said, "We look forward to other countries' focusing their attention on the human right situation in China, because human rights is a basic value. I hope the Western countries will devote more attention to the lawsuit and provide assistance to Spain." Chang expressed his support for the Spanish prosecutor and encouraged Falun Gong practitioners to spread the news. He said it was an effective way to tell the persecutors it wasn't acceptable to violate basic human rights.

Chang approves of the spread of information through the Internet. He said, "I strongly support Falun Gong practitioners though I don't practice Falun Gong. I didn't know what Falun Gong was a few years ago. I gradually learned about it because of practitioners' hard work. They did the right thing to help stop the persecution. I saw Falun Gong parades and activities in Hong Kong and in many places in Taiwan. I learned that this group of people tries to protect basic human rights and freedom of belief. However, the CCP wouldn't accept it. I support them. Democratic and free societies support them, too. They should continue and keep the fire burning. Persistence will bring them success."

Professor Ming-Yang Hsieh said the lawsuit in the Spanish Court proved there was no doubt that human rights was a universal value in democratic countries. More facts would be brought up as the lawsuit proceeded. The prosecutor instituted legal proceedings because the evidence was solid. As more evidence is provided to the judge and more pictures and testimonies are brought to the court and more media report on the lawsuit, people living outside of Mainland China would learn what was happening there. It is also an opportunity for the deceived Chinese people to see the nature of the CCP and be awakened. The CCP will feel the pressure of more of its people being aware of the evil nature of the CCP instead of simply the lawsuit itself. He added, "The exposure of facts brought by the lawsuit will become more significant than the court's final decision." People will find out the CCP is such a brutal regime. It is so cruel to its citizens. What wouldn't it do? Those who see the evil nature of the CCP will stop asking the tiger for its skin. Hsieh thought that would be the greatest outcome of the lawsuit in Spain.

Background:

Among the accused is ex-leader of the Chinese Communist Party Jiang Zemin. Jiang is widely acknowledged as the initiator and primary force behind the campaign launched in 1999 to "eradicate" Falun Gong." Also facing charges of genocide and torture in the Spanish case is Luo Gan, former head of the 610 Office, an extra-judicial agency set up to lead and coordinate the campaign against Falun Gong. Chinese human rights lawyers have compared the 610 Office to Nazi Germany's Gestapo in its operations, brutality, and extraordinary authority.

The other three accused are Bo Xilai, current Party Secretary for Chongqing and former Minister of Commerce; Jia Qinglin, the fourth-highest member of the Party hierarchy; and Wu Guanzheng, head of an internal Party disciplinary committee. The charges against the three are based on their alleged proactive advancement of the anti-Falun Gong campaign during their time as top officials in Liaoning Province, Beijing, and Shandong Province respectively.
